Provided, that when. <br /> <br />such failure, suspension, diminution or variation of service shall <br /> <br />aggregate more than 10 hours during any month, then equitable adjust- <br /> <br />ment shall be made in the monthly rate specified in this purchase order, <br /> <br />including the minimum monthly charge. <br /> <br />7, Facilities. Facilities, water rights, pumping.facilities and all <br /> <br />other facilities necessary for performance of this purchase order shall <br /> <br />be furnished, installed, operated and maintained by Seller at its expense, <br /> <br />except that Seller may use without charge the 10-inch water main owned by <br /> <br />the United States Government and use-permitted to the Office of Economic <br /> <br />Opportunity, which 10-inch water main connects Seller's present pump <br /> <br />house with the delivery point; provided, however, that Seller shall <br /> <br />maintain such water main, and provided further that Seller shall not <br /> <br />utilize such main for deliveries of water to other customers at such <br /> <br />times, in such quantities or in such manner a~ may prejudice in anywise <br /> <br />Seller's ability to perform its undertakings hereunder. <br /> <br />8. Re-deliveries. Buyer will re-deliyer.to Seller, at Seller's <br /> <br />flight line, such water that may be needed in connection with Seller's <br /> <br />airport adjacent to Gary Training Center, but not more than such quantities <br /> <br />as may be made available by Seller to Buyer in excess of Buyer's requirements. <br /> <br />. 3 - <br />
