<br />march 14, 1966 <br /> <br />page two <br /> <br />St. John's would now like to purchase the desired <br />3.62 acres of park land, instead of "swapping". <br />Mr. Serur read aloud an opinion from City Attorney <br />Albert M. Walker, reference the City's legal ability <br />to sel I park land. The letter is attached as a part <br />of the Minutes. A ful I discussion ensued. The City <br />Manager exhibited a map of the area, showing the 3.62 <br />acres needed by St. John's, and the portion of church <br />property which Fr. Trevino had offered to trade the <br />City at the previous meeting. Alderman Whittenberg <br />interjected the question of the worth of the 3.62 acres. <br />Elwood Soechting, recognized by the Mayor, asked if it <br />were correct that the City could not sell any part of <br />the park for a commercial use. The Mayor answered, <br />"Yes." Mr. Soechting asked if the church could sel I <br />for commercial purposes, and the Mayor repl ied that <br />the church would not sell the frontage. Alderman <br />Pool asked how the property is zoned. The Mayor re- <br />plied: "Public Use." Alderman Froh went to the map <br />to "clarify the discussion and questions". Alderman <br />Damon said if a sale or swap were to be considered, <br />the Council should know the value of the property. <br />Alderman Whittenberg moved that the Counci I hire a <br />competent appraiser to appraise the value of the 3.62 <br />acres of frontage land which St. John's is interested <br />in buying, and also the property previously offered for <br />trade; and that the City Manager be authorized to sel- <br />ect the appraiser. Alderman Tuttle seconded the motion. <br />Discussion continued. Alderman Damon said he was inter- <br />ested in seeing the City have more park land, instead of <br />less. The question being cal led for, the fol lowing vote <br />was recorded: <br /> <br />AYE: <br />NAY: <br /> <br />Damon, Froh, Pool, Tuttle, Whittenberg <br />None <br /> <br />The Mayor declared the motion carried. <br /> <br />The City Manager presented for Counci I consideration a <br />problem concerning garbage collection at a residence on <br />property half in and half out of City Limits. Bi I I <br />Younger's home is situated on the lot that is outside <br />the City Limits, but he pays City taxes on part of his <br />property, and has City water. After discussion, on mot- <br />ion of Alderman Whittenberg, the Counci I gave common con- <br />sent to giving Mr. Younger garbage collection service. <br /> <br />I <br /> <br />I <br /> <br />The Mayor read aloud a letter from T.K. Wood, District 14 <br />Engineer, Texas Highway Department, commenting on the Res- <br />olution on one-0ay traffic control on I 35 access roads <br />approved at the February 14 meeting. After lengthy dis- <br />cussion on the problem, Alderman Whittenberg moved that <br />the City Secretary write Mr. Wood and ask him if the decis- <br />i on-mak i ng auth6r'i.ty for one- and two- way traff i c contro I I <br />on access roads within the City Limits rests with the City <br />or with the Texas Highway Department.
