<br />AN ORDINANCE ORDERING AN ELECTION TO BE HELD IN THE CITY OF SAN MARCOS,
<br />TEXAS, ON THE QUESTION OF "SHALL A COMMISSION BE CHOSEN TO FRAME A NEW
<br />CHARTER?" AND, IF A MMORITY OF THE VOTERS AT SUCH ELECTION SHALL VOTE IN
<br />THE AFFIRMATIVE, THEN ALSO PROVIDING FOR THE'ELECTION OF A CHARTER COMMIS-
<br />SION TO FRAME A HOME RULE CHARTER, SUCH CHARTER TO THEN BE SUBMITTED TO
<br />THE VOTERS FOR ADOPTION OR REJECTION; DESIGNATING THE PLACES AT WHICH SAID
<br />FIRST ELECTION IS TO BE HELD; APPOINTING ELECTION OFFICIALS THEREFOR; AND
<br />CONTAINING OTHER PROVISIONS RELATING TO SAID ELECTIONS.

<br />WHEREAS, the City Council of the City of San Marcos, Texas, has determined,
<br />and hereby affirmatively determines that an election shall be held in the City
<br />of San Marcos to determine whether a commission shall be chosen to frame a home
<br />rule charter for the City of San Marcos, and, if a majority of the voters voting
<br />in said election shall vote in the affirmative, to provide for a commission to
<br />frame a home rule charter; and,
<br />
<br />WHEREAS, Article 1165, Revised Civil Statutes of Texas, 1925, provides
<br />that the governing body of a city having more than five thousand inhabitants
<br />may, by two-thirds vote of its members, provide by ordinance for the submission
<br />of the question ltshall a commission be chosen to frame a new charter?"; and,
<br />
<br />WHEREAS, Article 1166, Revised Civil Statutes of Texas, 1925, provides that
<br />provision should be made on the ballot containing such question for the election
<br />of a charter commission of not less than 15 members, nor more than one member
<br />for each three thousand inhabitants, provided, that a majority of the qualified
<br />voters voting on said question shall have voted in the affirmative; and,
<br />
<br />WHEREAS, it is hereby affirmatively found and determined (a) that the
<br />City of San Marcos has no home rule charter; and (b) that no regular municipal
<br />election is to be held within said city in not less than thirty nor more than
<br />ninety days after the date of adoption of this ordinance; and,
<br />
<br />WHEREAS, the City Council of the City of San Marcos, wishes to proceed
<br />with the ordering of the election for the submission to the resident Qualified
<br />voters of said city the question, I1shall a connnission be chosen to frame a new
<br />charter?"; -

<br />THEREFORE, BE IT ORDAIlffiD BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />Section 1: That a special election shall be held in and throughout the
<br />City of San Marcos, Texas~ on the 21st day of June, 1966, at which election
<br />there shall be submitted to the resident Qualified voters of said City, for their
<br />action thereupon, the following Question:

<br />Section 2: That said election shall be held in each of the election
<br />precincts within said city, and the polling places and presiding officers for
<br />each of said precincts shall be, respectively, as follows, to-wit:

<br />Section 3: That said election shall be held in accordance with the Consti-
<br />tution and laws of the State of Texas, and all duly Qualified resident electors
<br />of said City of San Marcos, Texas, shall be Qualified to vote.

<br />Section 4: That the ballots of said election shall bear no party designa-
<br />tion, and provision shall be made thereon for the election from the City at large
<br />of a Charter Commission of fifteen members. In addition, said ballot shall list
<br />the names of those Qualified persons who have duly filed for a place on said
<br />ballot as candidates for membership of the Charter Commission, and shall con-
<br />tain sufficient space for the voters at said election to write in the names of
<br />those persons they desire to vote for as members of said Commission.

<br />Section 5: That the ballots of said election shall conform to the reQuirements
<br />of Article 1166, Revised Civil Statutes of Texas, 1925, and to the reQuirements
<br />of Chapter 6 of the Election Code of the State of Texas (Chapter 492, Acts of
<br />the 52nd Legislature of Texas, Regular Session, 1951, as amended), and the lan-
<br />guage to be printed thereon shall include the following:
