<br />j~q <br /> <br />I <br /> <br />AN ORDINANCE DECLARING VACATED, ABANDONED <br />AND CLOSED A CERTAIN PORTION OF ALBEMARLE <br />STREET, A PART OF THE H. B. COFFIELD ADDI- <br />TION TO THE CITY OF SAN MARCOS; AND AUTHOR- <br />IZING THE EXECUTION OF A DEED BY THE MAYOR <br />OF THE CITY OF SAN MARCOS TO SOUTHWEST TEXAS <br />STATE COLLEGE OF ANY INTEREST THE CITY OF <br />SAN MARCOS MAY HAVE IN SUCH PORTION OF SAID <br />STREET. <br /> <br />****************************************** <br /> <br />WHEREAS, the City of San Marcos has received, from Southwest <br />Texas State College, a petition requesting the declaration by the <br />City of San Marcos that the hereinafter described portion of <br />Albemarle Street, a part of the H. B. Coffield Addition to the City <br />of San Marcos, henceforth be vacated, abandoned and closed; and, <br /> <br />WHEREAS, said petition does further request that the City of <br />San Marcos execute a deed without warranty, conveying all interest <br />of said city, if any, in such hereinafter described portion of said <br />street to the said Southwest Texas State College; and, <br /> <br />WHEREAS, the City of San Marcos, through its agents, has duly <br />determined that such portion of said street will not be used for any <br />public purpose in the foreseeable future, and that it, therefore, is <br />to the interest of the public in general and said city in particular <br />that such portion of said street be abandoned, vacated and closed, <br />immediately and permanently; and, <br /> <br />I <br /> <br />WHEREAS, the City of San Marcos, through its agents, has duly <br />determined that the said Southwest Texas State College is the sole <br />owner of all property abutting upon or against such portion of said <br />street: <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, as follows: <br /> <br />Section 1. That the hereinafter described portion of Albemarle <br />Street, a part of the H. B. Coffield Addition to the City of San Marcos, <br />is hereby declared to be and henceforth shall be vacated, abandoned <br />and closed as to any use, right or claim whatsoever of the public in <br />general and the City of San Marcos in particular. The portion of said <br />street so vacated, abandoned and closed is as follows: That portion <br />of Albemarle Street, as shown on the map of the H. B. Coffield Addition, <br />the map of said addition being of record in Volume "0", page 198, Hays <br />County Deed Records, as is bounded on its East side by Block No.2 of <br />the H. B. Coffield Addition; on its North side by Concho Street; on its <br />West side by Block No. 1 of the H. B. Coffield Addition; and on its <br />South side by Colorado Street. <br /> <br />I <br /> <br />, Section 2. That any interest the City of San Marcos may have in <br />such portion of said street be conveyed immediately by the City of San <br />Marcos to the said Southwest Texas State College for the consideration <br />of Ten Dollars ($10.00) and other good and valuable consideration, such <br />conveyance to be by deed without warranty executed by the mayor of said <br />city and attested by the secretary thereof. <br /> <br />PASSED, <br />A.D. 1966. <br /> <br />APPROVED AND ADOPTED this ~ day of tvilu \ <br /> <br />/~~~.! <br /> <br />Mayor of the City of San Marcos, <br /> <br />Texas <br /> <br /> <br />7:L/ <br />
