<br />of the building is less than 50% of its value, the Board of Adjustment may grant
<br />a permit for repair after a public hearing and having ~ue regard for the public
<br />welfare, safety, and the character of the area surrounding the nonconforming use
<br />property, keeping in mind the conservation and preservation of the adjacent prop-
<br />erty.

<br />SECTION 19 BOARD OF ADJUSTMENT:

<br />These is hereby created a Board of Adjustment consisting of five members, each
<br />to be appointed for a term of two years by the Mayor, with the approval of the
<br />City Council; the Board shall elect one of its members to act as Chairman. Any
<br />member may be removed for cause by the appointed authority upon; written charges
<br />and after a public hearing. The appointing authority shall fill vacancies for
<br />the unexpired term of any member whose term may become vacant. All cases to
<br />be heard by the Board of Adjustment will always be heard by a minimum number of
<br />four members.
<br />
<br />The Board shall adopt rules of procedure and be vested with all of the powers
<br />granted said Board in accordance with Article 1011g VTCS, as amended, as though
<br />that Article were incorporated herein; however, the Mayor shall indicate at the
<br />time of the appointment which two of the five members shall hold office for a
<br />period of one year and which three of the members so appointed shall hold of-
<br />fice for a two year term. After the initial appointment, the members appointed
<br />and re-appointed shall hold office for a period of two years unless a vacancy
<br />exists as herein provided.

<br />SECTION 20 ENFORCEMENTS AND REMEDIES:
<br />
<br />Any violation of this Ordinance or section thereof, is hereby declared to be
<br />a misdemeanor and, upon conviction, shall be subject to a fine of not less than
<br />$5.00 nor more than $200.00 for any violation.

<br />In case any building or structure is erected, constructed, reconstructed, al-
<br />tered, repaired, converted, or maintained or any building, structure, or land is
<br />used in violation of this Act or of any Ordinance or other regulation made under
<br />the authorities of the municipality, in addition to other remedies, the City
<br />may institute any appropriate action or proceedings to prevent such unlawful
<br />erection, construction, reconstruction, alteration, repair, conversion, mainten-
<br />ance, or use, to refrain, correct, or abate such violation, to prevent the occu-
<br />pancy of said building, structure or land, or to prevent any illegal act, conduct,
<br />busines~, or use in or about such premises.
<br />
<br />SECTION 21 CONFLICTING ORDINANCES:
<br />
<br />It is the intention of the Governing Body that this Ordinance should supplement
<br />existing ordinances, and any ordinance, word, phrase, clause, sentence, or section
<br />thereof in conflict with this Ordinance shall remain in full force and effect;
<br />however, in the event that this Ordinance shall impose a more restrictive re~uire-
<br />ment, then this Ordinance shall control.
<br />
<br />SECTION 22 SAVINGS CLAUSE:
<br />
<br />If any section, part, word, phrase, clause, or sentence or any provlslon of this
<br />Ordinance is declared unconstitutional or invalid, then, in that event, it is ex-
<br />pressly provided and it is the intention of the Governing Body in passing this Or-
<br />dinance, that all other parts of this Ordinance shall not be affected thereby
<br />and shall remain in full force and effect.

<br />SECTION 23 EFFECTIVE DATE:

<br />This Ordinance shall be in effect after a public hearing required by law, its
<br />legal passage by the Governing Body, and legal publication of this Ordinance in
<br />a newspaper of general publication and circulation in the area.
