<br />AN ORDINANCE ESTABLISHING MINIMUM HEALTH AND HOUSING STANDARDS; <br />PROVIDING FOR AN ENFORCING OFFICIAL; CREATING A BOARD OF HOUS- <br />ING APPEALS; PROVIDING FOR THE INSPECTION OF DWELLING AND PREM- <br />ISES; AND FOR OTHER PURPOSES. <br /> <br />WHEREAS, the elimination of slums and blighted areas and the pre- <br />vention of their future growth is a matter of concern to the people of <br />the City of San Marcos, Texas; and, <br /> <br />I <br /> <br />WHEREAS, in this City there are dwelling structures which are so <br />dilapidated, unsafe, unhygienic, or unsanitary, as to constitute a men- <br />ace to the health and safety of the people; and, <br /> <br />WHEREAS, this City has the right and duty to adopt and enforce such <br />health and sanitary regulations as are necessary in order to prevent the <br />spread of disease. <br /> <br />BE IT THEREFORE ORDAINED BY THE CITY COUNCIL OF SAN ~~RCOS, TEXAS: <br /> <br />SECTION 1. ADOPTION OF MINIMUM HOUSING CODE. <br />There is hereby adopted by the City Council of San Marcos, Texas, <br />that certain health and housing standards known as the 1965 Edition of <br />the Southern Standard Housing Code, of which not less than three (3) <br />copies have been and are now filed in the office of the Clerk of the <br />City of San Marcos, Texas, and the SallIe are hereby adopted and incorporated <br />as fully as if set out at length herein, and from the date on which this <br />ordinance shall take effect, the provisions thereof shall be controlling <br />on all dwellings and premises within the corporate limits of San Marcos, <br />Texas. <br /> <br />I <br /> <br />SECTION 2. ESTABLISHMENT OF THE OFFICE OF HOUSING ENFORCING OFFICIAL. <br />(a) The office of Housing Enforcing Official is hereby created. <br />(b) The Building Official shall be responsible for the enforcement <br />of this ordinance. <br />(c) The Building Official shall be appointed by the Mayor subject to <br />confirmation of the City Council. His appointment shall continue during <br />good behavior and satisfactory service. He shall not be removed from <br />office except for cause after full opportunity has been given him to <br />be heard on specific charges. <br /> <br />SECTION 3. ESTABLISHMEIIT OF A HOUSING BOARD OF APPEALS. <br />(a) There is hereby created a Board of Housing Appeals which shall <br />consist of five (5) members appointed by the Mayor subject to confirmation <br />of the City Council. One member shall be appointed to serve one (1) <br />year, two members to serve two (2) years, and two members to serve three <br />(3) years. <br />(b) This Board shall act by majority vote of the members present. <br />(c) Said Board shall have the power and be required to hold public <br />hearings in deciding appeals where it is alleged there is an error in <br />law or fact in any order or decision of the Housing Enforcing Official <br />in the enforcement of this ordinance. <br /> <br />SECTION 4. DUTIES OF THE HOUSING ENFORCING OFFICIAL. <br />It shall be the duty of the Housing Enforcing Official to enforce <br />all laws and provisions specified in the 1965 Edition of the Southern <br />Standard Housing Code. <br /> <br />I <br /> <br />SECTION 5. RIGHT OF ENTRY. <br />The Housing Enforcing Official, in the discharge of his official <br />duties, and upon proper identification, shall have authority to enter <br />any building, structure, or premises at any reasonable hour. <br /> <br />SECTION 6. SAVING CLAUSE. <br />Nothing in this ordinance or in the code hereby adopted shall be <br />construed to affect any suit or proceeding now pending in any court, <br />or any rights acquired, or liability incurred, nor any ca e or causes <br />of action accrued or existing, under any act or ordinance repealed <br />hereby. Nor shall any right or remedy of any character be lost, impaired <br />or affected by this ordinance. <br />
