<br />Ie L/ <br /> <br />AN ORDINANCE DEFINING "BICYCLE"; REQUIRING INSPECTION; <br />PROVIDING FORAN ANNUAL LICENSE AND ITS ISSUANCE- <br />TRANSFER OF LICENSE; ALTERING SERIAL NUMBERS; ES~AB- <br />L1SHING A CHARGE; IMPOUNDING; PROVIDING A PENALTY; <br />PROVIDING A SAVINGS CLAUSE; AND, ESTABLISHING AN <br />EFFECTIVE DATE. <br /> <br />I <br /> <br />WHEREAS, the City of San Marcos has no ordinance providing <br />for the registration or inspection of bicycles; and, <br /> <br />WHEREAS, such an ordinance is believed to be in the best <br />interest of the citizens of San Marcos to prevent bicycle larceny <br />and to provide a record of al I bicycles in the City of San Marcos: <br /> <br />NOW, THEREFORE, BE IT ORDAINED by the City Council of the <br />City of San Marcos as follows: <br /> <br />SECTI~N I. Definition: The term "bicycle" as used in this <br />Ordinance shall mean a device having two wheels. connected by a <br />frame of metal or wood, and designed to be propel led by human <br />power. This definition does not apply to toy tricycles or <br />velocipedes. <br /> <br />I <br /> <br />SECTION II. Inspection: The Chiefof Police, or his designated <br />representat i ve, sha II inspect each b i cyc Ie, to be licensed, to <br />determine if it is properly equipped as provided for in this <br />Ordinance or by State law. The Chief of Police, or his represent- <br />ative, shal I also question the applicant as to his or her know- <br />ledge of the vehicular :traffic laws of the State of Texas as they <br />apply to bicycles. No application for the registration of a bi- <br />cycle wi I I be issued unti I the Chief of Police, or his represent- <br />ative, is satisfied that the requirements of this Ordinance and <br />other applicable ordinances or laws of the State have been fulfi lied. <br /> <br />SECTION III, Annual License: It shall b~ unlawful for any person <br />to ride or use a bicycle within the City Limits witho~t having <br />first obta~ned an annual license therefor as hereinafter provided. <br /> <br />SECTION IV. Issuance of License: The Tax Assessor-Collector <br />is hereby authorized and empowered to issue, upon written appli- <br />cation approved by the Chief of Police or his represeritative, a <br />bicycle license to any person opiratinga bicycle within the City <br />Limits of the City of Sari Marcos. Th~license, so issued, shall <br />be valid for one calendar year. AI I lic~enses shall be due to be <br />affixed to the bicycle on or before Jan~ 'st of eachjear. Such <br />license, when issued, shal I entitle the licensee to operate the <br />bicycl~ for which the license was issued upon all the streets and <br />publ ic w~ys as permitted by this Drdinance or other ordinances as <br />may be applicable. <br /> <br />I <br /> <br />SECTIDN V. License: The Tax Assessor-Col'ecitor shall provide, <br />each year, a suitable license, together with re@istration certifi- <br />cate cards, serially numbered, beginning withNu~ber 100. The <br />license shal I be firmly attached to the rear of the bicycle in a <br />locatjonplainly visible. The license shall remain attached to <br />the bicycle during the valid term of such license. <br /> <br />SECTION VI. Transfer of License: It shall be the responsibility <br />of any person who sells or transfers ownership of any bicycle to <br />report such sale or transfer immediatetj by returning the <br />
