(3) Any deposit required by this section shall be refund- able at the end of the period of use upon determina- tion by the City of San Marcos that no damage to City facilities has occurred. (4) All other schedules of fees and charges for the use of parks and recreation facilities which may be in conflict herewith are hereby rescinded and repealed. SECTION 2. That section 18-8 of the Code of Ordinances, City of San Marcos, Texas, is hereby amended to read as follows: Sec. 18-8. Fee for use of ball parks. The parks and recreation director shall collect a fee in the amount of five dollars ($5.00) per hour for the use of any ball park maintained by the City of San Marcos when such use is for any purpose other than a supervised and sanctioned program of the city park and recreation department. SECTION 3. That section 18-9 of the Code of Ordinances, City of San Marcos, Texas, be, and the same is hereby repealed. SECTION 4. That this Ordinance shall be in full force and effect ten (10) days from and after passage and publication in a newspaper of general circulation in the area.
