<br />RESOLUTION <br /> <br />A RESOLUTION AUTHORIZING THE EXCHANGE OF LAND BY AND BETWEEN THE <br /> <br />CITY OF SAN MARCOS ON THE ONE HAND AND THE SAN MARCOS BAPTIST ACADEMY <br /> <br />ON THE OTHER, SUCH EXCHANGE TO INVOLVE NO ADDITIONAL CONSIDERATION OTHER <br />THAN SUCH LANDS THEMSELVES, TO BE CONSUMMATED AT THE EARLIEST PRACTICABLE <br />I DATE AND TO BE SUBJECT TO RESERVATION IN CITY OF SAN MARCOS OF USE OF <br />RESERVOIR. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS: <br /> <br />1. <br /> <br />That the City of San Marcos exchange with the San Marcos Baptist <br /> <br />Academy the tract of land, herein called FIRST TRACT, for that tract of <br /> <br />land, hrein called SECOND TRACT. <br /> <br />That such exchange shall involve the <br /> <br />conveyance and delivery of no consideration other than said tracts of <br /> <br />land themselves. That such exchange shall be consummated at the earliest <br /> <br />practicable date. That the City of San Marcos shall reserve full rights <br />I <br />I of use and access to the water reservoir presently located upon said <br />I II FIRST TRACT for a period of five (5) years from the date of such exchange <br /> <br />or until the completion of a water reservoir upon said SECOND TRACT, which- <br /> <br />ever event first occurs. <br /> <br />II. <br /> <br />Said FIRST TRACT is a portion of the T. J. Chambers Survey in Hays <br /> <br />County, Texas, described by metes and bounds as follows: <br /> <br />BEGINNING at a stone mound on the line between the W. H. <br />Steele tract and the A. S. Burleson tract, from which an elm <br />12" in diameter, marked X, bears S. 310 W. 36 varas; another <br />elm 8" in diameter, marked X, bears l). l7%: varas; <br /> <br /> THENCE N. 450 w. 36 varas to a stone mound for corner; <br /> THENCE N. 450 E. 36 varas to a stone mound for corner; <br />I THENCE S. 450 E. 36 varas to a stone mound for corner; <br /> THENCE S. 450 W. 36 varas to the place of beginning. <br /> The above-described land is a portion of that real property convey- <br />ed by and described in deed from the Texas Water Company to the City of <br /> <br />San Marcos, such deed being dated March 27, 1929, and recorded in Volume <br /> <br />98, pages 106-109, Hays County Deed Records. <br /> <br />III. <br /> <br /> <br />Said SECOND TRACT is also located in the T. J. Chambers Survey in <br />
