<br />AN ORD mANCE <br /> <br />I <br /> <br />AN ORDINANCE AMENDING ARTICLE V, SECTION 8 (b) BY FULL AND <br />COMPLETE SUBSTITUTION THEREFORE OF THE HEREINAFTER SET OUT SECTION <br />8 (b), SUCH AMENDMENT TO BE MADE TO THAT ORD INANCE ENTITLED "AN <br />ORDINANCE PRESCRIBING REGULATIONS FOR ALL RESTAURANTS IN THE CITY OF <br />SAN MARCOS; DEFINING CERTAIN WORDS AND PHRASES USED IN THIS ORDI- <br />NANCE; PROVIDING FOR ISSUANCE BY THE CITY HEALTH OFFICER OF PERMITS <br />FOR OPERATION OF RESTAURANTS AND PRESCRIBING FEES FOR SUCH PERMITS; <br />AUTHORIZING THE HEALTH OFFICER TO MAKE INSPECTIONS OF RESTAURANTS <br />AND PRESCRIBING SANITATION REQUIREMENTS FOR ALL RESTAURANTS; <br />PRESCRIBING CERTAIN REGULATIONS FOR THE CONTROL OF COMMUNICABLE <br />DISEASES; ADOPTING INTERPRETATIONS OF THE UNITED STATES PUBLIC <br />HEALTH SERVICE CODE REGULATING EATING AND DRINKING ESTABLISHMENTS <br />AS FILED WITH THE CITY CLERK; PRESCRIBING PENALTIES FOR VIOlATIONS <br />OF PROVISIONS OF THIS ORDINANCE; REPEALING ORDINANCES OR PARTS OF <br />ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SAVING CIAUSE: AND <br />DECLARING AN EMERGENCY," AS ADOPTED BY THE GOVERNING BODY OF THE <br />CITY OF SAN MARCOS ON OCTOBER 2, 1951 ON PAGE 164, VOLUME 13, OF <br />THE MINUTES OF SAID GOVERNING BODY, AND DECLARING AN EMERGENCY. <br /> <br />WHEREAS, it is found necessary and expedient by the City Council <br />of the City of San Marcos, Texas, in order to promote the public <br />health and prevent the spread of disease, to amend the above-entitled <br />ordinance as hereinafter set out; <br /> <br />NOW, THEREFORE, BE IT ORDAINED by the City Council of the City <br />of San Marcos, Texas, that: The present SECTIDN 8 (b) of Article V <br />of the above-entitled ordinance is hereby substituted for, in full <br />and completely, so that said section shall hereafter read as follows: <br /> <br />'I <br /> <br />SECTION 8. (b) The provisions of Article 705d of the Penal Code <br />of the State of Texas (Acts 1955, 54th Leg., p. 598, ch. 204) together <br />with future amendments thereof, are adopted as a portion of this <br />ordinance so far as applicable. <br /> <br />The public health and safety being presently endangered due to <br />the fact that the existing ordinances of the City of San Marcos do not <br />afford an adequate and comprehensive regulation of employees of <br />restaurants, as those terms are defined in the above-entitled ordinance, <br />therefore an emergency is apparent, requiring the provisions of the <br />Charter of the City of San Marcos, that ordinarilymquire ordinances to <br />be read on three several days and that no ordinance shall become <br />effective until me expiration of ten (10) days following the date of <br />its final passage, be dispensed with; thus, this ordinance shall be <br />effective immediately upon its passage by this body and its publica- <br />tion in a newspaper of general circulation within the City of San <br />Marcos. <br /> <br />PASSED, APPROVED AND ADOPTED THIS i'J- 7 ft, day of March, A.
