AN ORD mANCE I AN ORDINANCE AMENDING ARTICLE V, SECTION 8 (b) BY FULL AND COMPLETE SUBSTITUTION THEREFORE OF THE HEREINAFTER SET OUT SECTION 8 (b), SUCH AMENDMENT TO BE MADE TO THAT ORD INANCE ENTITLED "AN ORDINANCE PRESCRIBING REGULATIONS FOR ALL RESTAURANTS IN THE CITY OF SAN MARCOS; DEFINING CERTAIN WORDS AND PHRASES USED IN THIS ORDI- NANCE; PROVIDING FOR ISSUANCE BY THE CITY HEALTH OFFICER OF PERMITS FOR OPERATION OF RESTAURANTS AND PRESCRIBING FEES FOR SUCH PERMITS; AUTHORIZING THE HEALTH OFFICER TO MAKE INSPECTIONS OF RESTAURANTS AND PRESCRIBING SANITATION REQUIREMENTS FOR ALL RESTAURANTS; PRESCRIBING CERTAIN REGULATIONS FOR THE CONTROL OF COMMUNICABLE DISEASES; ADOPTING INTERPRETATIONS OF THE UNITED STATES PUBLIC HEALTH SERVICE CODE REGULATING EATING AND DRINKING ESTABLISHMENTS AS FILED WITH THE CITY CLERK; PRESCRIBING PENALTIES FOR VIOlATIONS OF PROVISIONS OF THIS ORDINANCE; REPEALING ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SAVING CIAUSE: AND DECLARING AN EMERGENCY," AS ADOPTED BY THE GOVERNING BODY OF THE CITY OF SAN MARCOS ON OCTOBER 2, 1951 ON PAGE 164, VOLUME 13, OF THE MINUTES OF SAID GOVERNING BODY, AND DECLARING AN EMERGENCY. WHEREAS, it is found necessary and expedient by the City Council of the City of San Marcos, Texas, in order to promote the public health and prevent the spread of disease, to amend the above-entitled ordinance as hereinafter set out; NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of San Marcos, Texas, that: The present SECTIDN 8 (b) of Article V of the above-entitled ordinance is hereby substituted for, in full and completely, so that said section shall hereafter read as follows: 'I SECTION 8. (b) The provisions of Article 705d of the Penal Code of the State of Texas (Acts 1955, 54th Leg., p. 598, ch. 204) together with future amendments thereof, are adopted as a portion of this ordinance so far as applicable. The public health and safety being presently endangered due to the fact that the existing ordinances of the City of San Marcos do not afford an adequate and comprehensive regulation of employees of restaurants, as those terms are defined in the above-entitled ordinance, therefore an emergency is apparent, requiring the provisions of the Charter of the City of San Marcos, that ordinarilymquire ordinances to be read on three several days and that no ordinance shall become effective until me expiration of ten (10) days following the date of its final passage, be dispensed with; thus, this ordinance shall be effective immediately upon its passage by this body and its publica- tion in a newspaper of general circulation within the City of San Marcos.
