<br />On this the 27th day of March, 1967, the City Council of the
<br />City of San Marcos, Texas, convened in Regular Session at the regular
<br />meeting place, the Council Chamber in the City Hall in the City of
<br />San Marcos, Texas, the following members present, to-wit:
<br />
<br />Mayor Serur, and Councilmen Caesar A. Damon, Joe C. Froh,
<br />Herman Korff, Wi I liam C. Pool and Mark H. Whittenberg
<br />
<br />constituting a quorum, when the following business was transacted:
<br />
<br />Mr. Wh i ttenberg introduced a written Ordinance, which was
<br />readin full, and moved its adoption. The motion was seconded by
<br />Mr. Poo I The motion for the adoption of the Ordinance
<br />prevailed with the following vote:
<br />
<br />Ayes: Damon, Froh, Korff, Pool, Whittenberg
<br />
<br />Nays: None
<br />
<br />The Ordinance follows:
<br />
<br />AN ORDINANCE OF THE CITY OF SAN MARCOS, HAYS COUNTY,
<br />TEXAS, A CITY DULY AND LEGALLY INCORPORATED AS A
<br />HOME RULE CITY UNDER THE LAWS OF THE STATE OF TEXAS,
<br />GRANTING TO THE LOWER COLORADO RIVER AUTHORITY, AN
<br />AGENCY OF THE STATE OF TEXAS, ITS SUCCESSORS AND
<br />ASSIGNS, UPON CERTAIN SPECIFIED CONDITIONS, A TEN YEAR
<br />AGREEMENT, AND CERTAIN EASEMENTS AND PRIVILEGES
<br />INCIDENT THERETO, FOR THE DISTRIB UTION OF ELECTRIC
<br />POWER AND ENERGY WITHIN THE CORPORATE LIMITS OF THE
<br />CITY OF SAN MARCOS, TEXAS, AS NOW EXISTING OR HEREAFTER
<br />EXTENDED
<br />
<br />BE IT ORDAINED AND ORDERED by the City Council of the
<br />City of San Marcos, Hays County, Texas:
<br />
<br />Section 1. That the word "Grantee" as employed in this Ordinance
<br />shall denote the Lower Colorado River Authority, an agency of the State
<br />of Texas, its SUCCessors and assigns.
<br />
<br />Section 2. That said Grantee shall be and is hereby granted the
<br />right for a period of ten (10) years from and after January 1, 1967, with
<br />full right, power and authority to erect, extend, operate and maintain
<br />towers, poles, wires, mains, pipes, and all other apparatus and .
<br />appliances, within the corporate limits of the City of San Marcos, Texas,
<br />as now existing or as may be hereafter extended, for the purpose of
<br />distributing electric power and energy for lights, heat and power, including
<br />distribution of electric power and energy to the City and its inhabitants,
<br />and for said purposes the privilege to enter upon and use the streets, alleys
<br />and public grounds of said City, and construct, maintain and operate on,
