I AN ORDINANCE DECLARING ABANDONED CERTAIN PORTIONS OF MOON STREET, EDWARD GARY STREET, CONCHO STREET, WOODS STREET, ROANOAK STREET, MATTHEWS STREET AND PLEASANT STREET WITHIN THE LIMITS OF THE CITY OF SAN MARCOS, TEXAS; AND AUTHORIZING THE EXECUTION OF A QUITCLAIM BY THE CITY OF SAN MARCOS TO SOUTHWEST TEXAS STATE COLLEGE OF ALL INTEREST OF THE CITY OF SAN MARCOS IN SUCH POR- TIONS OF SAID STREETS. WHEREAS, the City of San Marcos has received from the Southwest Texas State College a petition requesting the abandonment by the City of San Marcos of the hereinafter described portions of Moon Street, Edward Gary Street, Concho Street, Woods Street, Roanoak Street, Matthews Street and Pleasant Street within the limits of the City of San Marcos, Texas; and, WHEREAS, said petition further requests that the City of San Marcos execute a quitclaim to Southwest Texas State College of all interest of the City in such hereinafter described portions of said streets; and, WHEREAS, the City of San Marcos has duly determined that the Southwest Texas State College is the sole owner of all property abutting upon or against such hereinafter described portions of said streets in all but two cases, and in those two cases the owners of the abutting property have approved such abandonment and quitclaim; and, I WHEREAS, the City of San Marcos has duly determined that it is to the best interest of the public in general and the City of San Marcos in particular that such hereinafter de- scribed portions of said streets be immediately abandoned, and that all interest of the City of San Marcos in such portions of said streets be quitclaimed to said college: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, as follows: Section 1. That the hereinafter described portions of Moon Street, Edward Gary Street, Concho Street, Woods Street, Roanoak Street, Matthews Street, and Pleasant Street are hereby declared to be and henceforth shall be abandoned as to any use, right or claim in, or responsibility for the upkeep or maintenance by the public in general and the City of San Marcos in particular: (a) Moon Street, from its intersection with the north line of Colorado Street to its inter- section with the north line of Concho Street. I (b) Edward Gary Street, from its intersection with the north line of Colorado Street #0 . its intersection with the north line of> \I Roanoak Street. (c) Concho Street, from its intersection with the east line of North LBJ Drive to its intersection with the east line of Moon Street.
