<br />AN ORDINANCE PROVIDING FOR ABUILDING CODE TO
<br />GOVERN THE CONSTRUCTION, ALTERATION, REMOVAL
<br />DEMOLITION, EQUIPMENT, USE AND OCCUPANCY, AND
<br />MAINTENANCE OF BUILDINGS AND STRUCTURES;
<br />REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
<br />PROVIDING A SAVINGS CLAUSE; ESTABLISHING
<br />PENALTIES FOR VIOLATIONS~ AND DECLARING AN
<br />EMERGENCY. '

<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />Section 1. That there is hereby adopted by the City of San
<br />Marcos, Texas, for the purpose of establishing rules and regula-
<br />tions governing the construction, alteration, removal, demolition,
<br />equipment, use and occupancy, location and maintenance ot buildings
<br />and structures including permits and penalties, that certain build-
<br />ing code known as the "Southern Standard Building Code", being par-
<br />ticularly the"1965 Edition" thereof and the "1967 Revision" thereto,
<br />save and except such portions as are hereinafter modified or amended,
<br />of which not less than three (3) copies of both said Code and Revision
<br />have been and now are filed in the office of the City Secretary of the
<br />City of San Marcos, and the same are hereby adopted and incorporated
<br />as fully as if set out full length herein, and from the date on which
<br />this ordinance shall take effect, the provisions thereof shall be
<br />controlling in the construction of all buildings and other structures
<br />therein contained within the corporate limits of the City of San
<br />Marcos, Texas.

<br />Section 2. That all ordinances in conflict herewith are here-
<br />by repealed. In particular, but without limiting the generality of
<br />the foregoing, the ordinance promulgated by the City Council of the
<br />City of San Marcos on January 12, 1955, as of record in Volume 18,
<br />pages 93-~4, of the Minutes of the City Council, together with all
<br />amendments thereto, is hereby expressly repealed.
<br />
<br />Section 3. The invalidity of any section or pr0vision of this
<br />ordinance or of said Code shall not invalidate other sections or
<br />provisions thereof.

<br />Section 4. The said "Southern Standard Building Code" is
<br />amended and changed in the following respects:
<br />
<br />(1) Section 114 of said Code is amended so that it will
<br />now read in full as follows: Any person, firm, corporation or
<br />agent who shall violate a provision of this Code, or fail to comply
<br />therewith, or with any of the requirements thereof, or who shall
<br />erect, construct, alter, demolish or move any structure, or has
<br />erected, constructed, altered, repaired, moved or demolished a
<br />building or structure in violation of a detailed statement or
<br />drawing submitted and approved thereunder, shall be deemed guilty
<br />of a misdemeanor. Each such person shall be deemed guilty of a
<br />separate offense for each and every day or portion thereof during
<br />which any violation of any of the provisions of this code is
<br />committed, or continued, and, upon convication of any such viola-
<br />tion such person shall be punished by a fine of not less than Ten
<br />Dollars ($10.00) and not more than Two Hundred Dollars ($200.00).
<br />The imposition of the penalties herein prescribed shall not pre-
<br />clude the City of San Marcos from instituting an appropriate ac-
<br />tion or proceeding to prevent an unlawful erection, construction,
<br />reconstruction" alteration, repair, conversion, maintenance or
<br />use, or to restrain, correct or abate a violation, or to prevent
