<br />ORDINANCE
<br />
<br />AN ORDINANCE ESTABLISHING WATER USE CHARGES;
<br />REQUIREMENT OF SEPARATE CONNECTION AND METER
<br />FOR ALL PREMISES; PROVIDING FOR NO USE OF WATER
<br />OR CONNECTION TO WATER SYSTEM FREE OF CHARGE;
<br />REPEALING ALL ORDINANCES OR RESOLUTIONS IN CON-
<br />FLICT HEREWITH; PROVIDING A SAFETY CLAUSE; AND
<br />DECLARING AN EMERGENCY.
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />Section 1. A charge shall be paid by all persons, firms, partnerships
<br />corporations or governmental entities owning or occupying premises, wh ch
<br />are connected with the water system of the City of San Marcos, Texas, n
<br />accordance with the following scheduled rates, and charges as are here n-
<br />after described are hereby levied and assessed as hereinafter provided
<br />(a) For any number of gallons of water used or not used, from none to two
<br />thousand (2000)---$1.50 per month.
<br />(b) For any use of water from two thousand (2000) to five thousand (5000)
<br />gallons, an additional charge of $0.30 for each thousand (1000) gallons or any
<br />part thereof.
<br />(c) For the use of water from five thousand (5000) to ten thousand (10,000)
<br />gallons, an additional charge of $0.25 for each thousand (1000) gallons or any
<br />part thereof.
<br />(d) For the use of water over ten thousand (10,000) gallons---an additional
<br />charge of $0.20 each thousand (1000) gallons or any part thereof.

<br />Section 2. No water shall be sold to any person, firm, partnership, corporation
<br />or governmental entity unless application has been made to and granted by the
<br />City of San Marcos, Texas, for connection of the applicant's private water line
<br />with a part of the water system of the City of San Marcos, Texas. In this
<br />connection, each dwelling unit in all "R" (Single-Family Dwelling District) zoned
<br />districts, shall be individually metered. The designation of an "R" (Single-
<br />Family Dwelling District), as set out in that Zoning Ordinance of the City of
<br />San Marcos, Texas, dated May 23, 1966, and of record in Volume 23, pages 51-61,
<br />Minutes of the City Council of the City of San Marcos, Texas, is hereby adopted
<br />verbatim for the purposes of this section of this ordinance.

<br />Section 3. No water wi 11 be furni shed by the City of San Marcos, Texas, except
<br />upon the schedule of charges above-outlined.
<br />
<br />Section 4. All ordinances, resolutions, or parts of ordinances or resolutions,
<br />in conflict herewith are hereby repealed to the extent of such conflict.
<br />
<br />Section 5. If any section, subdivision, paragraph, clause, phrase or sentence
<br />of this ordinance, or the application thereof to a particular person, firm,
<br />partnership, corporation or governmental entity, or to a particular set of
<br />circumstances, should, for any reason, be held invalid, such invalidity shall
<br />in no wise affect the remaining provisions hereof, and to such end the various
<br />provisions hereof are declared to be separable.
<br />
<br />Section 6. The public welfare, health and safety being presently endangered
<br />due to the fact that the existing ordinances of the City of San Marcos, Texas,
<br />do not afford adequate and comphrehensive provisions for the effective and
<br />efficient operation of the water system of the City of San Marcos, Texas; there-
<br />fore, an emergency exists, requiring that the provisions of the Charter of the
<br />City of San Marcos, Texas, that ordinarily require ordinances to be read on three
<br />several days and that no ordinance shall become effective until the expiration
<br />of ten (10) days following the date of its final passage, be dispensed with,
<br />thus, this ordinance shall be effective immediately upon its passage by this body.
