<br />1-- -- <br /> <br />regular meeting, june 23, 1969 <br /> <br />page two <br /> <br />AN ORDINANCE AMENDING THE ORDINANCE WHICH <br />ESTABLISHES MINIMUM FINES TO BE LEVIED BY <br />THE CORPORATION COURT OF THE CITY OF SAN <br />MARCOS IN CERTAIN SITUATIONS AND UNDER CER- <br />TAIN LIMITATIONS, BY THE SUBSTITUTION OF <br />AN ENTIRELY NEW SECTION NO. 1 FOR THE PRE- <br />SENT SECTION NO.1; DECLARING AN EMERGENCY; <br />AND PROVIDING FOR LEGAL PUBLICATION HEREOF <br /> <br />Dr. Craddock moved adoption of the Ordinance. <br />Mr. Smith seconded the motion and on roll call, the <br />following vote was recorded: <br /> <br />I <br /> <br />AYE: Craddock, Contreras, Dannelley, Flores, <br />Serur, Smith, Zavesky <br /> <br />NAY: None <br /> <br />The Mayor declared the Drdinance Passed, Approved and <br />Adopted. <br /> <br />The Mayor introduced three Resolutions with identical <br />captions, as f611ows: <br /> <br />A RESOLUTIDN OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, AUTHORIZING THE CITY MANAGER <br />TO BRING SUIT AGAINST THE OWNERS OF LAND <br />HEREIN DESCRIBED TO ACQUIRE SEWAGE DISPOSAL <br />LI NE EASEMENTS <br /> <br />The Mayor read the names of property-owners, and <br />location of property, stated in each Resolution. <br />Councilman Smith moved approval of the three <br />Resolutions. Councilman Zavesky seconded the motion <br />and on roll call, the following vote was recorded: <br /> <br />I <br /> <br />AYE: Craddock, Contreras, Dannelley, Flores, <br />Serur , Smith, Zavesky <br /> <br />NAY: None <br /> <br />The Mayor declared ~he three ~esolutions Passed and <br />Approiled. <br /> <br />The Mayor read a16ud a lette-r from the Planning & <br />Zoning Commission, recommending a change of zoning <br />on two tracts of land on Lamar Street from "R" to "D", <br />see attached. Dr. Craddock mbved approval of the <br />change of zoning from "R" to "0" o~ the specified <br />tract~ of land ~n Lamar Street. Mr. Flores seconded <br />the motion. Mr. Serur announced procedure to be <br />followed, should visitors care to speak to the motion. <br />First, all those who appr6ved the change of zoning <br />would be given an opportunity to speak; second, those <br />opposed; and last, one proponent of the ~han~e would <br />be given a chance for rebuttal. He asked all who wished I <br />to speak to give their names and addresse~. <br />Herbert E. Karren of San Marcos Properties, who had <br />requested ~he change of zoning, ~resented facts and <br />figures supporting his statement that the change 6f <br />zoning would benefit the City of San Marcos. He <br />handed the Mayor a petition signed by six of the seven <br />property-owners within 200 feet of the tracts under <br />consideration for a change of zoning, requesting that <br />the land be zoned "D - multi-family". <br />Those speaking against the change of zoning were: <br />
