1-- -- regular meeting, june 23, 1969 page two AN ORDINANCE AMENDING THE ORDINANCE WHICH ESTABLISHES MINIMUM FINES TO BE LEVIED BY THE CORPORATION COURT OF THE CITY OF SAN MARCOS IN CERTAIN SITUATIONS AND UNDER CER- TAIN LIMITATIONS, BY THE SUBSTITUTION OF AN ENTIRELY NEW SECTION NO. 1 FOR THE PRE- SENT SECTION NO.1; DECLARING AN EMERGENCY; AND PROVIDING FOR LEGAL PUBLICATION HEREOF Dr. Craddock moved adoption of the Ordinance. Mr. Smith seconded the motion and on roll call, the following vote was recorded: I AYE: Craddock, Contreras, Dannelley, Flores, Serur, Smith, Zavesky NAY: None The Mayor declared the Drdinance Passed, Approved and Adopted. The Mayor introduced three Resolutions with identical captions, as f611ows: A RESOLUTIDN OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, AUTHORIZING THE CITY MANAGER TO BRING SUIT AGAINST THE OWNERS OF LAND HEREIN DESCRIBED TO ACQUIRE SEWAGE DISPOSAL LI NE EASEMENTS The Mayor read the names of property-owners, and location of property, stated in each Resolution. Councilman Smith moved approval of the three Resolutions. Councilman Zavesky seconded the motion and on roll call, the following vote was recorded: I AYE: Craddock, Contreras, Dannelley, Flores, Serur , Smith, Zavesky NAY: None The Mayor declared ~he three ~esolutions Passed and Approiled. The Mayor read a16ud a lette-r from the Planning & Zoning Commission, recommending a change of zoning on two tracts of land on Lamar Street from "R" to "D", see attached. Dr. Craddock mbved approval of the change of zoning from "R" to "0" o~ the specified tract~ of land ~n Lamar Street. Mr. Flores seconded the motion. Mr. Serur announced procedure to be followed, should visitors care to speak to the motion. First, all those who appr6ved the change of zoning would be given an opportunity to speak; second, those opposed; and last, one proponent of the ~han~e would be given a chance for rebuttal. He asked all who wished I to speak to give their names and addresse~. Herbert E. Karren of San Marcos Properties, who had requested ~he change of zoning, ~resented facts and figures supporting his statement that the change 6f zoning would benefit the City of San Marcos. He handed the Mayor a petition signed by six of the seven property-owners within 200 feet of the tracts under consideration for a change of zoning, requesting that the land be zoned "D - multi-family".
