<br />regular meeting! july 14, 1969 <br /> <br />page two <br /> <br />AN ORDINANCE PROHt~ITING THE D1SPENSING OF GASOLINE <br />BY ANY PERSON OTHER THAN THE OWNER, OPERATOR OR <br />EMPLOYEE OF A GASOLINE SERVICE STATION: PROHIBITING <br />ANY PERSON OTHER THAN A COMPETENT ATTENDANT FROM <br />DISPENSING GASOLINE; PROHIBITING CERTAIN PERSONS <br />FROM PERMITTING OTHERS TO VIOLATE THIS ORDINANCE; <br />PROHIBITING THE DISPENSING Of GASOLINE UNLESS A <br />COMPETENT ATTENDANT IS PRESENT: PRESCRIBING THE TYPE <br />OF DISPENSING DEVICES THAT MAY BE USED, AND PROHIBIT- <br />ING THE USE OF CERTAIN DISPENSING DEVICES; DEFINING <br />TERMS: PROVIDING THIS ORDINANCE TO BE EFFECTIVE WITH- <br />IN THE CITY LIMITS; REPEALING PRIOR ORDINANCES IN <br />CONFLICT; CONTAINING SEVERABILITY CLAUSE; PROVIDING <br />PENALTY; AND PROVIDING EFFECTIVE DATE. <br /> <br />I <br /> <br />Mr. Contreras moved that the request for the ordinance be <br />denied. Mr. Flores seconded the motion. Mr. lavesky read <br />the ordinance in full. In the discussion which followed, <br />Mr. Contreras pointed out that the self-service gasoline <br />stations represented a new industry in San Marcos, and an <br />addition to the tax rolls. "What's going to happen to <br />them, if we pass this ordinance?"he asked. Mr. Storey, <br />recognized by the Mayor, stated the regulatory ordinance <br />would not eliminate self-service stations, only requi~ <br />them to provide an attendant. Mr. Flores also expressed <br />concern for persons who had invested money in self-service <br />stations. Mr. Storey said the purpose of the ordinance <br />was to provide safety measures. Fred Hennenkamp of Lock- <br />hart was recognized by the Mayor. He said he represented <br />C & H Oil Co.: that he owned five stations, two in San Marcos. <br />He stressed the need for the ordinance, saying; " It's not <br />because we fear competition - we welcome competition - we <br />just don't want any gasoline fires". C.V. Carson also urged <br />passage of the ordinance. The question being called for, <br />the following vote was recorded: <br /> <br />I <br /> <br />AYE; Contreras, Flores <br />NAY: Craddock, Dannelley, Serur, Smith, lavesky <br /> <br />The Mayor declared the motion defeated. <br /> <br />Mr. Flores moved that the ordinance be t~ble~ until a <br />study could be made. Mr. Contreras seconded the motion <br />and on roll call, the following vote was recorded: <br /> <br />AYE: Contreras, Flores <br />NAY: Craddock, Dannelley, Serur, Smith, lavesky <br /> <br />The Mayor declared the motion defeated. <br /> <br />Mr. Smith moved adoption of th~ ordinance on first reading. <br />Mr. lavesky seconded the moti~n and on roll call, the follow- <br />lng vote was recorded; <br /> <br />AYE; Craddock,Oannelley, Serur, Smith, lavesky <br />NAY: Contreras, Flores <br /> <br />I <br /> <br />The Mayor declared th~ ordinance passed on first reading. <br />
