<br />I think we should make it clear that when Mr. Morgan <br />was employed by the city, he was not instructed simply to try to <br />"beat the case". On the other hand, he was instructed that the <br />Council viewed the matter very seriously, and wanted to be fair to <br />everyone, including the taxpayers of San Marcos, Mr. Hughson, the <br />city employees involved, and everyone else. He was, accordingly, <br />instructed to conduct the negotiations in a fair manner having in <br />mind that what the Council wanted was justice. <br />As a result of extended negotiations, the city and Mr. <br />Hughson have agreed upon a settlement in the amount of $3,500, <br />and this was agreed upon after considerable consultation, not only <br />with Mr. Hughson, but with Mr. J. C. Reagan, an attorney of New <br />Braunfels, who also represents Mr. Hughson. Because of the fact <br />that we all realize the city cannot payout money except for those <br />things for which the city is legally liable, it is my belief that <br />this matter of a settlement should be submitted to a District Court <br />II having jurisdiction, and if that court finds that the city officials <br />are acting within their authority in making the settlement, then we <br /> <br />I <br /> <br />will all be protected in making the payment. I have explained this <br />to Mr. Hughson and his attorney, and they are agreeable. <br />Consequently, if the Council believes that this type of <br />settlement is in the best interest of the people of San Marcos, then <br />I respectfully request a motion from you authorizing this settlement, <br />subject to the approval of the District Court. <br />I would also at this time like to have a motion authorizing <br />the payment of Mr. Morgan's fee for his services in this case, and <br />authorizing the payment of the court costs that will accrue as a <br />result of the matter being submitted to the court. <br /> <br />I <br /> <br />c....~ <br />4j <br />
