BEFORE THE PUBLIC UTILITY <br />COMMISSION OF TEXAS <br /> <br />APPLICATION OF LOWER ~ <br />COLORADO RIVER AUTHORITY ~ DOCKET NO. 3522 <br />FOR A RATE INCREASE ~ <br /> SETTLEMENT AGREEMENT <br /> <br />TO THE HONORABLE PUBLIC UTILITY COMMISSION OF TEXAS: <br /> <br /> NOW COME LOWER COLORADO RIVER AUTHORITY, WHOLESALE CUSTOMERS <br />ASSOCIATION, PEDERNALES ELECTRIC COOPERATIVE, INC., THE CITIES OF SAN <br />MARCOS AND KERRVILLE, AND THE PUBLIC UTILITY COMMISSION STAFF, to present <br />to the Commission their agreement, evidenced by the following terms, as to <br />the disposition which should be made of the present case. The Cities of <br />San Marcos and Kerrville have joined in this settlement agreement with <br />respect to rates and charges for electric power and energy provided by <br />Lower Colorado River Authority outside the city limits of any city, and the <br />Cities urge the adoption of the settlement; however, the Parties agree that <br />this settlement agreement is not intended to and does not bind the Cities <br />of. San Mar~o~ and Ke~rville acting in their capacities as Regulatory <br />Authorities under the Public Utility Regulatory Act, nor does this <br />agreement foreclose any action the Cities may take thereunder. <br /> <br /> The Parties to this agreement and to this case agree that the rate <br />f~iling package of the Lower Colorado River Authority, containing the <br />prefiled testimony of the Au~thority's witnesses, and the testimony <br />prefiled by the other parties in this case, may be offered and received <br />into evidence without objection. <br /> <br /> The parties further agree that, without necessity for further hearing <br />or the presentation of direct testimony or cross-examination of any <br />witness, the Public Utility Commission of Texas may enter its Final Order <br />based upon the suggested findings of fact and conclusions of law set out <br />below. The suggested findings of fact and conclusions of law with respect <br />to revenue requirements and billing determinants are drawn from and are <br />based generally upon the testimony of the Public Utility Commission Staff <br />prefiled in this cause. <br /> <br /> As part of their negotiated agreement with respect to the allocation <br />of revenue requirements among the classes, each of the Parties has <br /> <br /> <br />
