undertaken to and does hereby urge the Public Utility Commission to adopt <br />new rates effective for service provided on and after February 25, 1981. <br />Each of the Parties has agreed to use its best efforts to achieve the <br />effectiveness of the new rates on February 25, 1981, but it should be <br />understood that none of the Parties is urging the Commission to adopt rates <br />to become effective before a Final Order is signed by the Commission. The <br />Parties hereby waive :the time periods for exception~ and replies to <br />exceptions to the Examiner's Report provided by Procedural Rule 82, and <br />urge the Examiner to set this matter for final order hearing to be <br />scheduled in mid-February, 1981. <br /> <br /> The Parties have made this agreement as a result of a negotiated <br />settlement in the public interest of all issues and controversies in this <br />cause. This agreement is made by the parties on the express condition that <br />none of the Parties shall be deemed to have approved, accepted, agreed, or <br />consented to any rate-making principle or any method of cost of service <br />determination, cost allocation, or rate design underlying or supposed to <br />underlie any of the rates provided for ~herein wi~h respect to any future <br />proceedings. <br /> <br /> Each of the parties further reserves the right to withdraw its <br />participation in and consent to this agreement and, at any time prior to <br />the expiration of time for filing motions for rehearing in this cause, to <br />insist upon its right to a full public hearing, should it appear that the <br />Commission intends to adopt or has adopted a final order which deviates in <br />a material way from the resolution of the issues set forth in the following <br />suggested findings of fact and conclusions of law. <br /> <br /> FIND~'NGS OF FACT <br /> <br /> 1. Lower Colorado River Authority is a governmental agency of the <br />State of Texas. selling electric power and energy at wholesale and retail <br />throughout a large area of central Texas pursuant to a Certificate of <br />Convenience and Necessity issued by the Public Utility Commission of Texas. <br /> <br /> 2. On October 31, 1980, Lower Colorado River Authority filed a <br />Statement of Intent to increase its revenues by $5,680,176. <br /> <br /> 3. A return for Lower Colorado River Authority in the amount of <br />$27,404,691 provides the Authority a reasonable return on its invested <br /> <br />-2- <br /> <br /> <br />
