termination of Lessee's right of possession, and (3) all rent and other sums required to be paid by <br />Lessee during the remainder of the entire lease term. <br />(g) Upon eviction or voluntary vacating of the Leased Premises by Lessee without the <br />Lease being terminated by Lessor, Lessor shall make reasonable efforts to relet the Leased Premises. <br />After deduction of reasonable expenses incurred by Lessor through reletting the Leased Premises <br />during the remainder of the lease term or renewal or extension period. Such deductible expenses <br />may include real estate commissions, attorney's fees, and all other expenses in connection with <br />reletting. Lessee shall not be entitled to credit for any monthly rental receipts which are over and <br />above the monthly rent due under this Lease. Any action to collect amounts due by Lessee under this <br />Lease may be brought from time to time on one or more occasions without the necessity of Lessor's <br />waiting until the expiration of the lease term. In the event judgment for accelerated rents is <br />recovered, Lessor shall give credit against such judgment for subsequent rentals received, less lawful <br />deductions and expenses of reletting. Lessee shall be liable to any real estate agent signing this <br />Lease for leasing commissions lost by such agent due to Lessee's default. <br />(h) Lessor may elect to terminate this Lease as contrasted to termination of possession <br />rights only upon default by Lessee or at any time after Lessor's lawful re -entry or repossession <br />following default by Lessee. Lessor's agents have authority to terminate this Lease only by written <br />notice given pursuant to Paragraph 28.1. <br />(i) If Lessee holds over beyond the last day of the lease term, renewal terms, or <br />negotiated extension period, Lessor may exercise all rights set forth in Paragraph 26.2 regarding <br />holdovers; and, notwithstanding any other provision of this Lease, Lessor may immediately exercise <br />landlord's lien, lock change, utility termination rights under this Lease, without delay and without <br />prior notice to Lessee. Lessor may also exercise lease extension rights in accordance with Paragraph <br />26.2 if Lessee holds over. <br />0) In addition to other remedies, to the extent permitted by law and without Lessee <br />waiving any immunity or limits on liability granted under applicable laws, Lessor may recover <br />actual damages resulting from Lessee's default. <br />(k) Notwithstanding any other provisions in this Lease to the contrary, it being <br />understood that Lessee is a governmental entity operating a publicly funded program, Lessor <br />acknowledges that it expressly waives and shall not assert any liens or other claims of right, title or <br />interest in or to any personal property, files, documents and any other possessions of Lessee or its <br />officers, agents, employees or clients on or in the Leased Premises. <br />20.1. Lien for Rent. [Paragraph Deleted] <br />21.1. Attorney's Fees, Interest, and Other Expenses. All sums due and unpaid by Lessor or <br />Lessee under this Lease shall bear interest at the maximum lawful rate of interest from date of <br />default under Paragraphs 18.1 or 19.1(a) until paid plus any late payment fees due under this Lease. <br />Late payment fees shall be considered liquidated damages for the time, trouble, and inconvenience <br />incurred by Lessor in collecting late rentals. Late payment fees shall not be liquidated damages for <br />Lessor's loss of use of such funds during the time of delinquency. If Lessee is in default under this <br />Lease and if it becomes necessary for Lessor to place this Lease in the hands of an attorney in order <br />to enforce the rights or remedies of Lessor, Lessor may recover reasonable attorney's fees even if <br />suit has not been filed.
