THE STATE OF TEXAS <br />COUNTY OF CALDWELL <br />LEASE AGREEMENT FOR OFFICE SPACE <br />This is a Lease Agreement made and entered into between Ibex Leasing Company, hereinafter <br />referred to as "Lessor ", and the City of San Marcos, Texas, hereinafter referred to as "Lessee ", <br />whether one or more. <br />1.1 The Leased Premises. Lessor hereby leases to Lessee, and Lessee hereby leases from <br />Lessor the "Leased Premises" which consists of all of the following: <br />(a) Office Space. Exclusive use of the building known as 1003 West San Antonio Street <br />(the "Building "). Such space is located in Professional Plaza, an office park (hereinafter called the <br />"Development "), which is located on a tract of land (the "Land ") described as follows: 1.7 acres of <br />land, more or less, being a part of and out of the F. Berry Survey, Abstract #2, Lockhart, <br />Caldwell County Texas, and being that certain tract of land conveyed by Richard Fielder to J. <br />Tom Connolly be deed dated October 13, 1972, and recorded in Volume 351 of the Deed <br />Records of Caldwell County, Texas. The Leased Premises' street address is: 1003 San Antonino <br />Street, Lockhart, Texas, 78644. <br />(b) Exterior Common Area. Non - exclusive rights to use the exterior common area located <br />outside the buildings on the above - described land, i.e., loading areas, sidewalks, driveways, parking <br />areas, and other open areas (if any), subject to Paragraph 9.2 on parking. The term "Leased <br />Premises" shall mean Lessee's office space and the common area of which Lessee has non - exclusive <br />use. The terms "Office Space ", "Common Area ", "Building ", "Development ", and "Land" as used <br />in this Lease shall have the meanings set forth above. <br />1.2. Use. Lessee's office space shall be used only for professional offices. <br />1.3. Net Rentable Area. Lessee's "Net Rentable Area" is, based on Caldwell County <br />Central Appraisal District figures, 1466 square feet. <br />2.1 Base Rent. Lessee shall pay to Lessor a base rent in the sum of $10,800.00 per <br />calendar year (which amounts to $900.00 per calendar month). Lessor and Lessee <br />hereby agree and confirm that the Lessee's Net Rentable Area is the floor plan <br />attached hereto as Exhibit "A" which is an approximation and may not accurately <br />reflect Lessee's Net Rentable Area agreed to herein. (Also, see Exhibit D, Special <br />Provisions) <br />2.2 <br />One- twelfth of the yearly base rent is due on the first day of each calendar month and shall be <br />deemed as delinquent if not paid on that date. <br />If any rent payment is not received by Lessor within 5 days after its due date, Lessee shall pay a late <br />charge of 5% of rent payment. Payment of rent by check shall be on a bank based in the United <br />States.
