<br />I <br /> <br />I <br /> <br />I <br /> <br />158 <br /> <br />RESOLUTION NO. 1979-2-R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, ORDERING AN <br />ELECTION TO BE HELD ON THE 7TH DAY OF <br />APRIL, 1979 FOR THE PURPOSE OF ELECTION <br />OFFICIALS FOR SAID CITY AND ESTABLISH- <br />ING PROCEDURE FOR SAID ELECTION. <br /> <br />WHEREAS, the laws of the State of Texas provide that on April 7, <br />1979, there shall be elected the following officials for this <br />City: <br /> <br />Council Member, Place 6 <br />Council Member, Place 7 and <br /> <br />WHEREAS, the laws of the State of Texas and the Charter of the <br />City of San Marcos provide for amendments to said Charter to be <br />submitted as ballot propositions in conjunction with the Regular <br />City Officers' Election; and <br /> <br />WHEREAS, the laws of the State of Texas further provide that the <br />Election Code of the State of Texas is applicable to said election, <br />and in order to comply with said Code, an order should be passed <br />establishing the procedure to be followed in said election, and <br />designating the voting places and presiding officials for said <br />election; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. That all independent candidates at the election to be <br />held on the first Saturday in April, April 7, 1979, for the <br />abovementioned offices file their application to become candidates <br />for Place 6 or Place 7 with the Mayor of this City at City Hall, <br />on or before 30 days before the date of said election. <br /> <br />PART 2. That all of said applications shall be substantially in <br />the following form: <br /> <br />"To the Mayor of the City of San Marcos, Texas: <br /> <br />I hereby request that my name be placed upon the <br />official ballot for the election to be held on the <br />7th day of April, 1979, as a candidate for Place <br />Council Member of said City. I hereby <br />certlfy that I am above the age of 18 years, a <br />qualified elector and have resided 12 months next <br />preceding said election in said City, and I am <br />eligible to hold office under the Constitution of <br />this State. <br /> <br />DATED this the <br /> <br />day of <br /> <br />, 1979. <br /> <br />NAME OF CANDIDATE <br /> <br />RECEIVED the <br /> <br />day of <br /> <br />, 1979. <br /> <br />Mayor" <br /> <br />PART 3. That all candidates shall file with said application the <br />loyalty affidavit required by Article 6.02 of the Election Code. <br /> <br />PART 4. That the Secretary of this City shall, in accordance <br />with the terms and provisions of Article 13.32 of the Election <br />Code, post in her office the names of all candidates who have <br />filed their applications in accordance with the terms and <br />provisions of this order, and said names shall be posted at a <br />conspicious place in said office for at least 10 days before said <br />Secretary orders the same to be printed on the ballot for said <br />election. <br />
