<br />I <br /> <br />I <br /> <br />I <br /> <br />and of the rules, regulations, and relevant <br />orders of the Secretary of Labor. <br /> <br />(e) The Center will furnish all information and <br />reports required by Executive Order 11246, and <br />by rules, regulations, and orders of the <br />Secretary of Labor or pursuant thereto and <br />will permit access to its books, records, and <br />accounts by the administering agency and the <br />Secretary of Labor for purpose of investigation <br />to ascertain compliance with such rules, <br />regulations, and orders. <br /> <br />IX. Protection of Workmen and Prevailing Wage Laws <br /> <br />The Center shall, when applicable, comply with Articles <br />S159a, 5182, and 5182-1 of the Texas Civil Statutes. <br /> <br />X. Center Work Hours and Safety Standards Act Compliance <br /> <br />1. This Contract is subject to the following provisions <br />and to all other applicable provisions and exceptions <br />of the Contract Work Hours, and Safety Standards Act <br />and the regulations of the Secretary of Labor there- <br />under. <br /> <br />~ <br /> <br />(a) Neither the Center nor any subcontractor <br />contracting for any part of the contract <br />work which may require or involve the employment <br />of laborers or mechanics shall require or permit <br />any laborer or mechanic in any work week in which <br />he is employed on such work in excess of eight <br />hours in any calendar day or in excess of forty <br />hours in such work week unless such laborer <br />or mechanic receives compensation at a rate <br />not less than one and one half times his basic <br />rate of pay for all such hours worked in excess <br />of eight hours in any calendar day or in such <br />work week, whichever is the greatest number <br />of overtime hours. <br /> <br />(b) No laborer or mechanic shall be required to <br />work in surroundings or under working conditions <br />which are unsanitary, hazardous or dangerous <br />to his health and safety as determined under <br />construction, safety and health standards <br />promulgated by the Secretary of Labor by <br />regulation (29 CFR 1518, 36 F.R. 7340 April 17, <br />1971) . <br /> <br />XI. <br /> <br />This contract is not intended to supersede or contravent <br />that certain agreement executed between the parties dated <br />That agreement shall <br />stand equally with the foregoing provisions and where <br />possible, all portions of that prior agreement shall <br />be construed and interpreted so as not to stand in <br />conflict with the present agreement. <br /> <br />CITY OF SAN MARCOS <br /> <br />By: <br /> <br />~d~ <br /> <br />Royal Dunlap, Clty Manager <br />
