<br />TO: <br /> <br />FROM: <br /> <br />IKT: <br /> <br />DATE: <br /> <br />25 <br /> <br />~ ofSan)1arcos <br /> <br />OFFICE MEMORANDUM <br /> <br />Mayor and City Council Members <br /> <br />Doriss Hambrick <br />City Secretary <br /> <br />CHARTER REFERENDUM PETITION <br /> <br />February 26, 1979 <br /> <br />RE: <br /> <br />CERTIFICATION <br /> <br />'I <br /> <br />CSM-IOO <br /> <br />- <br /> <br />As you all know, a petition was presented to the City SecretarYI <br />on February 15, 1979 by Dawn L. Smith. The petition, carrying the <br />signatures of 556cpersons, asked that the following propositions be <br />placed on the April Election ballot: <br /> <br />Proposition I: The Charter of the City of San Marcos <br />shall be amended to give the people the right to call <br />a vote to approve or reject any excessive spending or <br />excessive taxes levied by the City Council, by deleting <br />the following wording which excludes this right: <br />Article VI, Section 6.01 shall be amended to delete <br />from the first sentence: ", except ordinances appropriat- <br />ing money. or levying taxes, or ordinances repealing <br />ordinances appropriating money or levying t~xes,~. <br /> <br />Proposition II: The Charter of the City of San Marcos <br />shall be amended to give the people the right to call <br />a vote to approve or reject issuance of bonds, by <br />amendment deleting the following words which exclude <br />this right: Article VI, Section 6.02 shall be amended <br />to delete from t!'1e first sentence: ", except that <br />ordinance authorizing the issuance of bonds (either <br />tax bonds or revenue bonds), whether original or <br />refunding bonds, shall not be subject to such referendum." <br /> <br />Of the 556 signatures appearing on the petition, 110 have <br />been declared void because there is reason to believe that the <br />signer is not a registered voter of the City, or the signer has <br />signed the petition more than once, or the signature appears to <br />be that of someone other than the person whose name was signed. <br />Therefore, the petition is declared to contain the valid signatures <br />of 446 registered voters of the City of San Marcos.
