68. <br />Regular Meeting April 12, 2004 Page 4 <br /> <br />Mayor Habingreither introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE TRAFFIC REGISTER MAINTAINED UNDER SECTION 82.067 OF THE <br />SAN MARCOS CITY CODE BY DELETING TIME-RESTRICTED PARKING ALONG THE <br />EAST SIDE OF WALNUT STREET; AND INCLUDING PROCEDURAL PROVISIONS. <br /> <br />Ms. Narvaiz moved for approval of the Ordinance on first reading and Mr. <br />Diaz seconded the motion. Mr. O'Leary stated the Downtown Parking <br />Committee recommended the adoption of this Ordinance. Mr. Mihalkanin <br />requested maps be provided to the Council at the second reading. The <br />Council then voted unanimously for the approval of the Ordinance on first <br />reading. <br /> <br />Mayor Habingreither introduced for consideration reconsideration of a <br />Zoning Ordinance. The Council did not wish to reconsider this Ordinance. <br />The caption reads as fOllows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 0.14-ACRE <br />TRACT OF PROPERTY LOCATED AT 312 JACKMAN STREET, FROM nM" SINGLE- <br />FAMILY, DUPLEX AND NEIGHBORHOOD BUSINESS DISTRICT TO UR-l" SINGLE- <br />FAMILY DWELLING DISTRICT (LOW DENSITY); INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />Mayor Habingreither introduced for consideration adoption of a Resolution, <br />the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AUTHORIZING EMINENT DOMAIN PROCEEDINGS TO ACQUIRE 0.038, 0.037, AND <br /> 0.722 ACRE TRACTS OF LAND IN THE J.M. VERAMENDI SURVEY NO. 2 IN <br />CONNECTION WITH THE POST ROAD PAVING AND DRAINAGE IMPROVEMENTS <br />PROJECT; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Habingreither stated some citizens have signed up to speak on this <br />Resolution. 1) Ray Harris stated he is one of the property owners and he <br />feels he has not received a fair offer for his property. He encouraged <br />the Council to table this Resolution until he can work out an agreeable <br />amount. 2) E. Cloughly stated he is speaking on behalf of Ray Harris. He <br />stated only a portion of the property would be left, and it would be <br />unreasonable to sell or do anything with the property. He encouraged the <br />Council to delay this Resolution until an agreement can be worked out. <br />Mro Thomaides inquired as to the timetable regarding this project. Mr. <br />O'Leary stated this right-of-way has to be resolved before the City can <br />proceed with the project. Mr. Thomaides inquired as to the eminent domain <br />process.
