<br />I <br /> <br />(13) There shall be no off-street parking requirements in the <br />Central Business Area as that area is defined in Section 16 of <br />the General Zoning Ordinance of San Marcos. <br /> <br />(14) Establishments located in a "C-2" CoJmlercial District on <br />November 20,1978, as indicated upon the Zoning Map of the City <br />and which were dispensing liquor, wine, or beer for on-premise <br />consumption under permit by the State of Texas on said date arB <br />exempt from the requirements of Section 2 1/2-4 (E)( 5). <br /> <br />SECTION 7 . That Section 2 1/2-4(G) of Ordinance 1979-13, amending <br />Chapter 2 1/2 of the Code of Ordinances of the City of San Marcos, Texas, <br />entitled "Alcoholic Beverages", adopted March 26, 1979, be, and is hereby, <br />repealed. <br /> <br />SECTION 8. That a new Section 2 1/2-4(G) be, and is hereby, <br />substituted for said repealed section, which shall read as follows: <br /> <br />2 1/2-4(G). Conditional Use Permits issued by the City shall require <br />renewal or reapplication if there is any change in the status of <br />the State license or permit such as cancellation or expiration or <br />renewal. The following procedure shall be followed: <br /> <br />(1) The Conditional Use Permit previously granted for the <br />p:rewises shall be presented to the Zoning Administrator. <br /> <br />I <br /> <br />(2) The Zoning Administrator shall investigate the premises to <br />detennine whether those premises remain in compliance with the <br />terms of the Conditional Use Permit, including any variances <br />granted. <br /> <br />(3) If the Zoning Administrator detennines that the premises <br />remain in compliance with the Conditional Use Permit and those <br />variances granted, the renewal or reapplication shall be approved <br />and the Conditional Use Permit shall remain in effect. <br /> <br />(4) If the Zoning Administrator determines that the premises do <br />not remain in compliance with the Conditional Use Permit and those <br />variances granted, the renewal or reapplication shall be denied, the <br />Conditional Use Permit shall no longer be in effect, and the <br />applicant shall proceed according to Section 2 1/2-4(D)(3)(B). <br /> <br />SECTION 9. 'That Section 2 1/2-4(H) of Ordinance 1979-13, amending <br />Chapter 2 1/2 of the Code of Ordinances of the City of San Marcos, Texas, <br />entitled "Alcoholic Beverages", adopted March 26, 1979, be, and is hereby, <br />repealed. <br /> <br />SECTION 10. That Section 2 1/2-4(1) of Ordinance 1979-13, amending <br />Chapter 2 1/2 of the Code of Ordinances of the City of San ME.rcos, Texas, <br />entitled "Alcoholic Beverages", adopted March 26, 1979, be, and is hereby, <br />repealed. <br /> <br />I <br /> <br />,/l".LlJJ <br />;x-c, <br />1-1 <br /> <br />SECTION 11. That a new Section 2 1/2-4(1) be, and is hereby, <br />substituted for said repealed section, which shall read as follows: <br />f/ <br />2 1/2-4 CO . In accordance with the authority granted to <br />municipalities by the State, the City of San Marcos shall have <br />the right to imnediately suspend the Conditional Use Permit <br />for any property where the premises are determined to be an <br />imnediate hazard to the health and safety of any person or <br />an :iJ:nmediate danger to any adj acent property. Such suspension <br />shall be for a period not to exceed twenty-four (24) hours or until <br />the danger or hazard is rerroved. Said suspension shall occur <br />only upon written statement of the alleged hazard filed by the <br />Chief Sanitarian or Fire Marshall with the office of the City <br />Hanager. <br />
