<br />I <br /> <br />I <br /> <br />I <br /> <br />WAR RAN T Y <br /> <br />DEE D <br /> <br />THE STATE OF TEXAS <br />COUNTY OF HAYS <br /> <br />I <br />I <br />I <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />THAT the City of San Marcos, Texas, a municipal corporation <br />of Hays County, Texas, (hereinafter called "Grantor"), acting by <br />and through its duly authorized official, Mr. John Hansen, Mayor <br />of the City of San Marcos, Texas, for and in consideration of the <br />sum of Forty Thousand Seven Hundred Twenty and 00/100, ($40,720.00), <br />in hand paid by COHEN AND COHEN, of Hays County, Texas, (hereinafter <br />called "Grantee", and considered in the singular sense whether one <br />or more), the receipt of which is hereby acknowledged, have GRANTED, <br />SOLD AND CONVEYED, and by these presents do GRANT, SELL AND CONVEY, <br />unto Grantee all the following described, to-wit: <br /> <br />TRACT ONE <br /> <br />FIELD NOTE DESCRIPTION OF A SURVEY OF 25,450 SQUARE FEET <br />OF LAND AREA IN THE J. M. VERAMENDI NO ONE SURVEY, HAYS <br />COUNTY, TEXAS, AND CONSISTING OF PART OF LOT ONE OF THE <br />J. Q. CLIETT FIRST ADDITION TO THE CITY OF SAN MARCOS AS <br />RECORDED IN VOLUME 128 PAGE 328 AND PART OF LOT ONE OF THE <br />J. Q. CLIETT SECOND ADDITION TO THE CITY OF SAN MARCOS AS <br />RECORDED IN VOLUME 128 PAGE 601 OF THE HAYS COUNTY DEED <br />RECORDS, AND SAID TRACT MORE PARTICULARLY DESCRIBED AS <br />FOLLOWS: <br /> <br />Starting at an iron pin set for a corner of tract and lot <br />3 of J. Q. Cliett First Addition at the intersection of the <br />North line of Grove Street and the East line of McGehee <br />Street; <br /> <br />Thence with the East line of McGehee Street NO 8 II' W <br />132.55 feet for the South corner and beginning point of <br />this tract, thence with the East line of McGehee Street <br />NO 8 11' W 132.55 feet to an iron pin set for the West <br />corner of this tract, and at the intersection of the East <br />line of McGehee Street and the South line of Cheatham Street; <br /> <br />Thence with the South line of Cheatham Street N82 00' E <br />192.00 feet to a point and said point being the North corner <br />of this tract and the Northwest line of the old P. <br />Rodriguez tract; <br /> <br />Thence leaving the South line of Cheatham street S08 11' E <br />132.55 feet to a point for the East corner of this tract <br />and with the West line of C. M. Allen Parkway; <br /> <br />W 192.00 feet to the Place of Beginning for <br />the South corner of this tract. There being <br />these metes and bounds 25,450 square feet of <br /> <br />Thence S82 00' <br />this tract and <br />contained with <br />land area. <br /> <br />/ <br /> <br />TO HAVE AND TO HOLD the above.mentioned premises,/together with <br />all and singular, the rights and appurtences thereto in anywise be- <br />longing, unto the said Grantee, his successors or assigns, forever. <br /> <br />THIS Deed is made and executed upon and is subject to certain <br />express conditions and covenants, said conditions and covenants being <br />a part of the consideration for the property hereby conveyed and are <br />to be taken and construed as running with the land upon the continued <br />observance of which and each of which, with the exceptions of cove- <br />nants numbered FIRST and THIRD, the continued existance of the estate <br />granted shall d~pend, and the Grantee hereby binds himself and his <br />successors, asslgns, grantees and lessees forever to these covenants <br />and conditions, which covenants and conditions are as follows" <br />
