I I I WAR RAN T Y DEE D THE STATE OF TEXAS COUNTY OF HAYS I I I KNOW ALL MEN BY THESE PRESENTS: THAT the City of San Marcos, Texas, a municipal corporation of Hays County, Texas, (hereinafter called "Grantor"), acting by and through its duly authorized official, Mr. John Hansen, Mayor of the City of San Marcos, Texas, for and in consideration of the sum of Forty Thousand Seven Hundred Twenty and 00/100, ($40,720.00), in hand paid by COHEN AND COHEN, of Hays County, Texas, (hereinafter called "Grantee", and considered in the singular sense whether one or more), the receipt of which is hereby acknowledged, have GRANTED, SOLD AND CONVEYED, and by these presents do GRANT, SELL AND CONVEY, unto Grantee all the following described, to-wit: TRACT ONE FIELD NOTE DESCRIPTION OF A SURVEY OF 25,450 SQUARE FEET OF LAND AREA IN THE J. M. VERAMENDI NO ONE SURVEY, HAYS COUNTY, TEXAS, AND CONSISTING OF PART OF LOT ONE OF THE J. Q. CLIETT FIRST ADDITION TO THE CITY OF SAN MARCOS AS RECORDED IN VOLUME 128 PAGE 328 AND PART OF LOT ONE OF THE J. Q. CLIETT SECOND ADDITION TO THE CITY OF SAN MARCOS AS RECORDED IN VOLUME 128 PAGE 601 OF THE HAYS COUNTY DEED RECORDS, AND SAID TRACT MORE PARTICULARLY DESCRIBED AS FOLLOWS: Starting at an iron pin set for a corner of tract and lot 3 of J. Q. Cliett First Addition at the intersection of the North line of Grove Street and the East line of McGehee Street; Thence with the East line of McGehee Street NO 8 II' W 132.55 feet for the South corner and beginning point of this tract, thence with the East line of McGehee Street NO 8 11' W 132.55 feet to an iron pin set for the West corner of this tract, and at the intersection of the East line of McGehee Street and the South line of Cheatham Street; Thence with the South line of Cheatham Street N82 00' E 192.00 feet to a point and said point being the North corner of this tract and the Northwest line of the old P. Rodriguez tract; Thence leaving the South line of Cheatham street S08 11' E 132.55 feet to a point for the East corner of this tract and with the West line of C. M. Allen Parkway; W 192.00 feet to the Place of Beginning for the South corner of this tract. There being these metes and bounds 25,450 square feet of Thence S82 00' this tract and contained with land area. / TO HAVE AND TO HOLD the above.mentioned premises,/together with all and singular, the rights and appurtences thereto in anywise be- longing, unto the said Grantee, his successors or assigns, forever. THIS Deed is made and executed upon and is subject to certain express conditions and covenants, said conditions and covenants being a part of the consideration for the property hereby conveyed and are to be taken and construed as running with the land upon the continued observance of which and each of which, with the exceptions of cove- nants numbered FIRST and THIRD, the continued existance of the estate granted shall d~pend, and the Grantee hereby binds himself and his successors, asslgns, grantees and lessees forever to these covenants and conditions, which covenants and conditions are as follows"
