MAOCOS, TEXAS, BY <br />ADDING TI'1iO LOCATIONS AT WHICH POLICE ARE AUTHORIZED <br />'ill REMJilE VEHICLES AND DErAILING IDI'ICE REQUIRE- <br />MENTS; AMENDING SECTION 29-123, ENTITLED "NO PARK- <br />ING ANYTIME~H OF ARrICLE V, ENl'ITLED "TRAFFIC- <br />CONTROL DEVICES" OF CHAPTER 29, ENTITLED "TRAFFIC" <br />OF THE CODE OF ORDINANCES, CITY OF SAN MARCOS, TEXAS, <br />BY DELETING ONE IlXATION AT WHICH PARKING IS PRO- <br />HIBITED AT ALL TINES AND ADDING ThO LOCATIONS AT <br />WHICH PARKING SHALL BE ProHIBITED AT ALL TIMES AND <br />DECLARING AN EMERGEN:Y. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAWMARCOS, TEXAS: <br /> <br />SECTION 1. That section 29-152, entitled ":I:mpoundment of standin;[ or <br />parked vehicles", of Article VII, entitled "Stopping, Standing and Parking" <br />of Chapter 29, entitled "Traffic" of the Code of Ordinances, City of San <br />Marcos, Texas, is hereby amended to read as follows: <br /> <br />Sec. 29-l52. ImpoundrrEntof standing or parked vehicles. <br />(a) Members of the police department are hereby authorized <br />to remove a vehicle fran a street or highway to the nearest <br />garage or other place of safety, or to a garage designated or <br />maintained by the police department or otherwise maintained by <br />this city, under the follC1.Ving circumstances; <br /> <br />(1) When any vehicle is left unattended upon any bridge, <br />viaduct or causeway where such vehicle contitutes an <br />obstruction to traffic. <br /> <br />(2) When a vehicle upon.a highway is so disabled as to <br />constitute an obstruction to traffic and the person in <br />charge of the vehicle is, by reason of physical injury, <br />incapacitated to such an extent as to be unable to pro- <br />vide for its custody or rerrova1. <br /> <br />(3) When any vehicle is left unattended upon a street and <br />is so parked illegally as to constitute a hazard or 0b- <br />struction to the normal movement of traffic. <br /> <br />(4) When any vehicle is illegally parked so as to block the <br />entrance to any private driveway it is impracticable <br />to move such vehicle fran in front of the driveway to <br />another point on the public street. <br /> <br />(5) When any vehicle is parked within fifteen (15) feet of <br />a fire hydrant, except within an officially marked park- <br />ing stall. <br /> <br />(6) When any vehicle is parked within twenty (20) feet of the <br />driveway entrance to any fire station and, on the side <br />of a street Opj;lOsite the entrance to any fire station, <br />within seventy-five (75) feet of such entrance (when <br />properly sign-posted). <br /> <br />(b) Whenever an officer rerroves a vehicle frorrr,a street as <br />authorized in this section, the police department shall <br />notify within ten (10) days thereof, by registered or <br />certified mail, return receipt requested, the last !mown <br />registered. owner of said vehicle and all lien holders of <br />record pursuant to the Texas Certificate of Title Act, <br />Article 6687-1, V.T.C.S. that the vehicle has been taken <br />into custody. Said notification shall state the fact of <br />such rerroval and the reasons therefore and the place to <br />which said vehicle has been removed. <br />
