<br />Hi5 <br /> <br />ORDlNANCE NO. tq <br /> <br />I <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, AMENDING SECTION <br />15.2, ENTITLED "TEMPORARY USE OF LAND BY <br />MOBILE HOMES" OF APPENDIX A, ENTITLED <br />"GENERAL ZONING ORDINANCE" OF THE CODE OF <br />ORDINANCES OF SAID CITY BY DELETING THE <br />PROVISION WHICH MANDATES DENIAL OF AN <br />APPLICATION FOR A PERMIT TO TEMPORARILY <br />PLACE A MOBILE HOME UPON OPPOSITION BY <br />AN OWNER OF LAND WITHIN TWO HUNDRED (200) <br />FEET IN EACH DIRECTION; BY DELETING THE <br />PROVISION WHICH ALLOWS THE OWNER OF PROPERTY <br />WITHIN TWO HUNDRED (200) FEET OF THE <br />PROPOSED LOCATION TO CAUSE REMOVAL OF THE <br />MOBILE HOME AND DECLARING AN EFFECTIVE DATE. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />11:1 <br />C':; <br />..-I <br />CO <br />::LJ <br />UJ <br /> <br />SECTION!. That section 15.2, Entitled "Temporary use <br />of land by mobile homes," of Appendix A. Entitled "General <br />Zoning Ordinance" of the Code of Ordinanoes, City of San <br />Marcos, Texas, is hereby amended to read as follows: <br /> <br />Section 15.2 Temporary use of land by mobile <br />homes. <br />A mobile home, as the term is defined in Section <br />4 of this ordinanoe, may be placed temporarily <br />in any zoned district provided the following <br />requirements are first satisfied. <br /> <br />I <br /> <br />1. Compliance with all pertinent provisions <br />of the m~nimum housing, building, plumbing <br />and electrical codes, as presently in force <br />or hereafter amended, of the City of San <br />Marcos. <br /> <br />2. All applications for a permit to temporarily <br />place a mobile home upon a certain tract of <br />land shall be made by the owner of the land <br />which is the subject of the application and <br />shall be processed in the same manner as <br />applications for changes of zoning, as <br />provided in Section 2 of this ordinance. <br />Under no circumstances shall a temporary <br />mobile home permit be issued to any person <br />other than the owner of land in question, <br />nor to any owner already holding two such <br />permits for the land in question. Such <br />permit shall not be granted for a period <br />in excess of twenty-four (24) months. <br /> <br />I <br /> <br />3. If the holder of a permit to temporarily <br />place a mobile home upon a certain tract <br />of land desires the extension thereof, he <br />shall make application for such extension <br />a minimum of thirty (30) days prior to the <br />expiration date of the original permit. <br />An application for an extension of a permit <br />shall be processed in the same manner as <br />applications for the original permits. <br /> <br />4. For each public hearing held in connection <br />with any original or extension permit, a <br />fee of twenty-five dollars ($25.00) shall <br />be paid by the applicant to the City of <br />San Marcos toward the discharge of the <br />expenses of such hearing. <br />
