<br />17d <br /> <br />III <br /> <br />shall so provide, and the remaining of that personal property <br /> <br /> <br />on said premises shall be guaranteed by the City of San Marcos, <br /> <br /> <br />and shall be the obligation of the City as well as the said <br /> <br /> <br />Association toward Aquarena, Incorporated. The said sub-contract <br /> <br /> <br />of lease between the City and the said Association shall further <br /> <br /> <br />provide that if, as and when said Association moves to other <br /> <br /> <br />premises, it shall not have the right to take such moveable <br /> <br /> <br />property to its new location, but all of same shall remain on <br /> <br /> <br />the premises of Aquarena, Incorporated, golf course, and this <br /> <br /> <br />result shall be guaranteed by the City of San Marcos, as well <br /> <br /> <br />as by the said Association. Nothing herein contained is in- <br /> <br /> <br />tended to prohibit or prevent the said Association from trading <br /> <br /> <br />in the existing equipment for similar new equipment, or from <br /> <br /> <br />purchasing additional equipment during the term of this lease, <br /> <br /> <br />but the title to all such new equipment, when hereafter acquired, <br /> <br /> <br />shall immediately vest in Aquarena, Incorporated, apd shall in <br /> <br /> <br />all things be governed by this contract, and the City of San <br /> <br /> <br />Marcos shall so contract with the said Association ~n the pro- <br /> <br /> <br />posed instrument of sublease. The City of San Marcos shall fur- <br /> <br /> <br />nish to Aquarena, Incorporated, a copy of its proposed form of <br /> <br /> <br />contract of sublease with the said Association, and said sub- <br /> <br /> <br />lease shall be approved by Aquarena, Incorporated, prior to its <br /> <br /> <br />execution, otherwise this lease contract to the City of San Marcos <br /> <br /> <br />shall be null and void, and of no force and effect. <br /> <br /> <br />The lease for the years 1968 through 1977, inclusive, were <br /> <br /> <br />similar to this lease, in that the City of San Marcos paid rent <br /> <br /> <br />in the precise amount of all ad valorem taxes on said property for <br /> <br /> <br />each of said year, and was reimbursed for one-half (~) thereof by <br /> <br /> <br />the San Marcos Golf Association. <br /> <br /> <br />VII. <br /> <br />I <br /> <br />I <br /> <br />The purpose of this lease is to permit Lessee to continue to <br /> <br /> <br />operate said property as a municipal golf course; and Lessee binds <br /> <br /> <br />and obligates itself that it will use said property solely and ex- <br /> <br /> <br />clusively for the purpose of conducting thereon a ~unicipal golf <br /> <br /> <br />course, and will not use said property, or any part thereof, for <br />
