<br />17, <br /> <br />any other purpose; and will not assign this lease in whole or in <br /> <br /> <br />part; and will not sublet any part of the property covered hereby, <br /> <br /> <br />to any person, firm, partnership, corporation, or any other <br /> <br /> <br />organization other than San Marcos Golf Association. <br /> <br />VIII. <br /> <br />I <br /> <br />A part of the consideration and rent for this lease agree- <br /> <br /> <br />ment is the obligation of the City of San Marcos to sublease the <br /> <br /> <br />said golf course to the San Marcos Golf Association by an instru- <br /> <br /> <br />ment in writing which shall not in any way be in conflict with, <br /> <br /> <br />but shall be wholly in accord with, the terms and provisions of <br /> <br /> <br />this lease to the City of San Marcos; and Aquarena, Incorporated, <br /> <br /> <br />reserves the right to review such sublease prior to its execution, <br /> <br /> <br />in order to form its own judgement and opinion as to whether or <br /> <br /> <br />not such total conformity is expressed in said sublease. <br /> <br />IX. <br /> <br />Lessee shall have the right to make improvements, betterments, <br /> <br /> <br />additions and repairs to the said golf course and the building <br /> <br /> <br />thereon used for club rooms and golf shop, as may be deemed necessary <br /> <br /> <br />II or advisable by Lessee from time to time, but any and all such im- <br /> <br /> <br />provements, betterments, additions and repairs shall be deemed per- <br /> <br /> <br />manent fixtures and a part of the realty and title thereto shall <br /> <br /> <br />immediately pass to and remain in Lessor. <br /> <br />X. <br /> <br />I <br /> <br />Lessee covenants to indemnify, save, hold and keep harmless, <br /> <br /> <br />the Lessor of and from any loss, cost, damage, cause of action, <br /> <br /> <br />expense or liability growing out of or arising from any accident <br /> <br /> <br />or occurrence causing injury to any person or property, due <br /> <br /> <br />directly or indirectly to the use, occupancy or possession of the <br /> <br /> <br />demised premises by Lessee, its agents, servants, employees, and <br /> <br /> <br />invitees; or due to Lessee's maintenance and operation of said <br /> <br /> <br />golf course, golf shop, club rooms, or any other facility connected <br /> <br /> <br />with or part of said demised property. Without limitation upon <br /> <br /> <br />the generality of the foregoing, Lessee agrees to procure and keep <br /> <br /> <br />in force liability insurance in not less than the amount of $50,000.00 <br /> <br /> <br />$100,000.00, if that can be done, in a company or companies accept- <br />
