<br />l7g <br /> <br />of God, neither party shall be under any obligation to replace <br />or restore such damaged or destroyed improvements. <br /> <br />XIV. <br /> <br />The Sub-Lessee, the San Marcos Golf Association, shall be at <br /> <br /> <br />full liberty during the term of this lease to make an arrangement <br /> <br /> <br />with a professiona~ golfer to operate a concession on said premises, <br /> <br /> <br />II and the profits, if any, realized by the professional golfer fronl <br /> <br /> <br />the operation of such concession on said premises, shall be and <br /> <br /> <br />remain the sole property of said golfer, and Lessor shall have no <br /> <br /> <br />claim, or assert any right to any part or percentage thereof. <br /> <br />XV. <br /> <br />I <br /> <br />Lessor reserves from. the land leased for golf course pur- <br />poses, the small area or portion thereof formerly used as a heli,- <br />port, marked off by posts with a cable running from post to post, <br />and forming an area enclosed by such posts and cabl~, except that <br />both ends of said area open on to a paved road, which paved road <br />affords ingress to and egress from Aquarena amusement area proper, <br />and the reservation of such area is for the parking of automobiles <br />when necessary, by the customers of Aquarena amusement enterprises. <br /> <br /> <br />Also, if additional parking space is needed at peak periods, <br /> <br /> <br />Aquarena, Incorporated, is authorized to recapture possession for <br /> <br /> <br />such period of time for public parking purposes, the tee end of <br /> <br /> <br />number seven (7) fairway for approximately seventy-five (75) <br /> <br /> <br />yards, thereby moving the tee temporarily toward_the hole about <br /> <br /> <br />seventy-five (75) yards, provided that no parking shall be per- <br /> <br /> <br />mitted on the elevated portion of the regular number seven (7) <br /> <br />tee. <br /> <br />XVI. <br /> <br />I <br /> <br />Lessee will require the San Marcos Golf Association to fur- <br /> <br /> <br />nish to Aquarena, Incorporated, and the City of San Marcos, a <br /> <br /> <br />monthly report of income and expenditures during the life of this <br /> <br /> <br />lease contract; and to provide that an annual audit of the books <br /> <br /> <br />of the Association be conducted by a well qualified and competent <br /> <br /> <br />auditor at the expense of the Association, and a copy of such <br /> <br /> <br />annual audit shall be furnished to Aquarena, Incorporated, and <br />
