<br />46a <br /> <br />PURSUANT TO SECTION 6-19 OF THE CODE OF ORDINANCES OF <br />THE CITY OF SAN MARCOS, TEXAS, THE FOLLOWING RULES AND <br />REGULATIONS ARE APPLICABLE TO THE SAN MARCOS CEMETERY: <br /> <br />1. INTERMENTS AND DISINTERMENTS. The City reserves the right <br /> <br />to refuse interment on any lot except upon written application by <br /> <br />the lot owner or owners made out on forms provided by the City <br /> <br />and duly filed in the Office of the City Secretary. The applicant <br /> <br />I <br /> <br />for an interment permit must specify the exact location of the <br /> <br />burial space desired to be opened. When instruction regarding the <br /> <br />location of an interment space cannot be obtained, or is indefinite, <br /> <br />or when for any reason the burial space cannot be opened where <br /> <br />specified, the Cemetery maintenance contractor of the City Secretary <br /> <br />may direct that the burial space be opened in such location on the <br /> <br />burial lot as they deem best and proper, so as not to delay the <br /> <br />funeral; and the City shall not be liable in damages for any error <br /> <br />so made. The City shall not be held responsible for any order given <br /> <br />by telephone, or for any mistake occurring for want of precise and <br /> <br />proper instructions as to the particular space, size, or location <br /> <br />on a lot where an interment is desired. Disinterment of a bOc,y <br /> <br />will not be permitted in the absence of a court order of a court <br /> <br /> <br />II of competent jurisdiction or written permission from some person <br /> <br /> <br />having authority to permit the same. Mortuaries performing the <br /> <br />service of interment or assisting in disinterments shall be <br />. / . . <br />respons~ble for the cleanlng of the graves~tes and removing all <br />/ <br />debris,' fill, or equipment resulting from or used by the mortuary <br /> <br />performing the service. The use of a concrete grave liner is <br />, <br /> <br />reqUiled for all interments made in cemetery sections for which v/ <br /> <br />perpe ual care is mandatory. <br /> <br /> <br />2. P RCHASE OF LOTS OR MAUSOLEUM CRYPTS. Cemetery lots or <br />I <br />mausoleum crypts may be purchased in the Office of the City <br /> <br />Secretary where plats showing the size, location and description <br /> <br />I <br /> <br />of all lots and the schedule of prices will be kept on file. <br /> <br />Cemetery lots will be selected exclusively at the Cemetery. <br /> <br />Deeds for any burial space will not be delivered to any purchaser <br /> <br />until the purchase price of the same and the cost of perpetual <br /> <br />care, when applicable, has been paid to the Finance Director in <br /> <br />full. Persons desiring to acquire multiple grave spaces in the <br /> <br />cemetery and not being able to pay the entire price thereof may <br /> <br />reserve same for a period not to exceed 180 days.
