<br />45c <br /> <br />Section 6-30. Investment of funds; disposition of revenue. <br /> <br />The City shall have the right to invest and reinvest the funds ad- <br />vanced to it for the purposes set forth in this division in interest <br />bearing bonds or securities of the city, state or federal government. <br />The interest, revenue or other accrual or increase of the funds ad- <br />vanced for a specific grave, lot or burial plot shall be used first <br />for the maintenance, care and upkeep of the particular lot, grave or I <br />burial plot for which the advancement or donation was originally <br />made. In the event of a reasonable excess of revenue from such <br />specific funds, such excess may, in the discretion of the trustee, <br />be used to beautify the whole cemetery generally, but at no time <br />shall any part of the original or principal amount first advanced <br />or donated for the care, upkeep or maintenance of a specific grave <br />or burial plot ever be used by such trustee. The original amount <br />shall remain and be kept intact as a principal trust fund. <br /> <br />Section 6-31. Records to be kept. <br /> <br />The City shall keep a permanent and well-bound book in which shall <br />be recorded, in alphabetical order, the names o~ all persons ad- <br />vancing funds under this division, the amount advanced, the name <br />and locations, insofar as possible, of lots and graves, the condition <br />and status of the trust imposed, and such other information as may <br />be, from time to time, deemed necessary by the City. <br /> <br />Section 6-32. Division does not affect right to care for lots <br />individually. <br /> <br />None of the rights, powers and duties provided for in this division <br />shall deprive any person having a proper interest in a grave or <br />burial plot, or kinship within the third degree by affinity or con- <br />sanguinity to those interred therein, from beautifying or caring <br />for the same individually, or at his own expense, subject always to <br />the rules and regulations imposed by the City. <br /> <br />I <br /> <br />Section 6-33. Successor trustee. <br /> <br />In the event the City should, after having entered and accepted <br />the trust provided for in this division, renounce such trust or <br />fail or refuse to act further as such trustee, the District Judge <br />of Hays County shall appoint a suitable successor to such trustee, <br />who shall carry out and faithfully execute the trust provided for <br />in this division. <br /> <br />Section 6-34. Fees for the purchase of perpetual care. <br /> <br />There is hereby established the following schedule of fees for the <br />purchase of perpetual care on burial spaces purchased at the San <br />Marcos Cemetery: <br /> <br />1 burial space........................ ..$250.00 <br />2 burial spaces............. .............310.00 <br />3 burial spaces..........................370.00 <br />4 burial spaces......................... .430.00 <br />5 burial spaces.......................... 490 :00 <br />6 burial spaces..... ...... ...............550.00 <br />7 burial spaces.......................... 610.00 <br />8 burial spaces.......................... 650.00 <br /> <br />I <br /> <br />The purchase of perpetual care will be required in the following <br />sections of the San Marcos Cemetery: <br /> <br />McGehee Addition; Old Original Addition; A.M. Ramsay Addition; <br />Roselawn Additio~; Dixon Addition, Sections 2, 3 and 4. <br />
