<br />I <br /> <br />.1 <br /> <br />45b <br /> <br />Section 6-25. Permits Required. <br /> <br />Prior to the interment or disinterment of any body, whether below <br />ground or in a mausoleum vault, or prior to the setting or resetting <br />of any grave marker except-the temporary marker placed by mortuaries, <br />or prior to the repair of any curbing or lot enclosure, a permit must <br />first be obtained from the City; application for said permit to be <br />made in writing, giving the exact location of the Cemetery lot or <br />crypt on which the work is to be performed, signed by th~ owner of <br />said lot or crypt or the owner's agent, and such other information as <br />may be deemed necessary by the City. <br /> <br />Section 6-26. <br /> <br />Permit fees. <br /> <br />There is hereby established the following schedule of permit fees for <br />work to be performed on the grounds of the San Marcos Cemetery: <br /> <br />McGehee Addition; Old Original Addition; Roselawn Addition; <br />A.M. Ramsay Addition; Dixon Addition; Sections 2, 3 and 4: <br /> <br />Interments or disinterments...............$20.00 <br /> <br />The setting ororesetting of grave markers.... .$5.00 <br /> <br />Repairs to or removal of existing curbing or any <br />other type of above ground enclosure... .......$5.00 <br /> <br />No fee shall be charged for a permit issued for work performed on a <br />cemetery lot for which a contribution has been made to the perpetual <br />care fund of the City of San Marcos, or for lots in Section 1 of <br />the Dixon Addition for which perpetual care charges are exempted, or <br />work done in the San Marcos Mausoleum. <br /> <br />Permit fees will be refunded in the event the full perpetual care fee <br />is paid on the lot for which the permit was issued within 180 days <br />of the permit date, providing that the applicant makes written <br />application to the City for said refund. <br /> <br />DIVISION 2. PERPETUAL CARE <br /> <br />Section 6-27. City to act as trustee. <br /> <br />The City is hereby authorized and empowered to act as a permanent <br />trustee for the perpetual care and upkeep of the lots, graves, burial <br />plots or blocks of lots which are within the confines of the San Marcos <br />Cemetery or which in the future may be within the limits of such <br />cemetery, and upon the acceptance of this trust, as provided for in <br />this division, the same shall become perpetual. <br /> <br />Section 6-28. Trust fund generally. <br /> <br />Any person desiring to have the City act as trustee for the permanent <br />care and upkeep of graves or burial lots shall have the right to <br />deposit funds as may be required by the City for such purpose, and <br />the acceptance by the City of the funds so deposited shall constitute <br />a permanent and perpetual trust fund for the burial lot or grave so <br />designated. <br /> <br />I <br /> <br />Section 6-29. Participating certificates. <br /> <br />Upon the acceptance by the City of the funds referred to in Section <br />6-28 the city secretary shall issue a certificate to the person ad- <br />vancing such funds which certificate shall state the purpose of the <br />donation, the amount donated, by whom donated, and the location, <br />insofar as possible, of the grave, lot or plot for which perpetual <br />care is desired and such other information as may be, from time to <br />time, deemed proper and necessary by the City. <br /> <br />All such certificates shall be issued in the name of the City to the <br />trustee or person making the advancement and the certificate holder <br />shall have the right, upon the payment of the proper fee and cost, <br />to have such certificate recorded in the deed records of Hays County <br />according to law. <br />
