The use of firearms, <br /> <br />explosives, tear gas, or obstacles in or near the leased area or at <br /> <br />the San Marcos Municipal Airport is specifically prohibited. <br /> <br />It is understood that the property shall not be available to <br /> <br />the general public while property is in use by Lessee. Lessee <br /> <br />shaLll have the exclusive right to schedule its activities and use <br /> <br />of the property subject to the exclusive right of the City of San <br />Marco, to demand that Le,'ee cea'e it' operation, temporarily II <br />during those periods of time when special events which are sanctioned <br />by the City of San Marcos are scheduled/on the leased property. <br />This exclusive right of the City of San Marcos is conditioned on <br />their giving Lessee 30 days written notice of the schedule events <br />or lesser notice upon mutual agreement of both parties. <br /> <br />3. During the time of war or national emergency Lessor shall <br /> <br />have the right to lease the landing area, airport or any part there- <br /> <br /> <br />of to the United States Government for military or naval use, and, <br /> <br /> <br />if such lease is executed, the provision of this instrument insofar <br /> <br /> <br />as they are inconsistent with the provisions of the lease to the <br /> <br /> <br />Government, shall be suspended. This lease shall be subordinate <br /> <br /> <br />to the-provisions of any existing or future agreement between Lessor <br /> <br /> <br />and the United States, relative to the operation or maintenance of <br /> <br /> <br />the airport, the execution of which has been or may be required as <br /> <br /> <br />a condition precedent to the expenditure of Federal funds for the <br /> <br /> <br />development of the ail'port. <br /> <br />I <br /> <br />4. TERM OF THIS LEASE AGREEMENT: Permission to use the pro- <br /> <br />perty granted herein shall be for a six month period beginning <br /> <br />March 14, 1978 and ending September 14, 1978, thereafter, permission <br /> <br />to use the property granted herein shall be on a month to month <br />basis, providing that the City may at any time after the first six <br /> <br />months of this lease, with or without cause, terminate and revoKe <br /> <br />this agreement and permission to use the property herein granted <br /> <br /> <br />and may take possession of the property without being guilty in <br /> <br />I <br /> <br />any manner of trespass upon giving 60 days written notice to the <br /> <br />Lessee. <br /> <br />5.
