altering or changing such rules, regulations and compensations shall, at the request of the electric utility affected, or upon call of the Mayor or majority of the City Council, either at a regular meeting of the Council, or at a special meeting called for such purpose, have a hearing before the City Council. In order to ascertain all the facts necessary for a proper understand- ing of what is, or could be, a reasonable rate or compensation, the electric utility shall, upon demand, submit to the City Councilor any other person designated by it, for inspection its books, records and schedules of rates or charges, as well as the rates proposed to be charged, and the City Council shall have full power to compel the attendance of witness for any such hearing before the Council. I For the purpose of evaluating any request for a rate adjustment, the electric utility shall submit to the City Council the following specific information. A. A detailed statement of annual operating costs for service within the corporate limits of the City of San Marcos for each of the five previous fiscal years of the electric utility. Such statements shall be certified by a Certified Public Accountant. B. Detailed statements of plant value and plant addition for service within the corporate limits of the City of San Marcos for each of the electric utility's previous five fiscal years. All statements of plant value shall represent original cost of equipment, less accumulated depreciation. All statements of plant value shall be certified by a Certified Public Accountant. C. A detailed statement of gross revenues by fiscal year according to all applicable rate schedules, and from all sources within the corporate limits of the City of San Marcos for the five preceding fiscal years. I SECTION 5. For the performance of the duties of the City Council and the enforcement of this ordinance relative to electric utilities, the Council shall have the right to select and engage rate consultants, accountants, auditors, attorneys, engineers, or any combination thereof, to conduct investigations, present evidence, advise and represent the governing body, and assist with litigation on public utility ratemaking proceedings. In accordance with the Charter of the City of San Marcos, and the laws of the State of Texas, the electric utility shall bear the full cost of such expert advice and assistance as defined hereinabove as chosen and deemed necessary by the City Council. SECTION 6. If any section, paragraph,' subdivision, clause, phrase or provision of this ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this Ordinance as a whole or any part or provisions thereof other than the part so decided to be invalid or unconstitutional.
