101. <br />Special Meeting April 19, 2004 Page 2 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING CHAPTER 106, SIGNS, OF THE SAN MARCOS CITY CODE, TO REVISE <br />AND CLARIFY SIGN AREA AS IT APPLIES TO OFF-PREMISES SIGNS; INCLUDING <br />PROCEDURAL PROVISIONS; AND DECLARING AN EMERGENCY. <br /> <br />Mayor Habingreither opened the public hearing and asked if anyone wished <br />to speak. No one did, so Mayor Habingreither closed the public hearing. <br />Ms. Narvaiz moved for adoption of the Ordinance on emergency and Mr. <br />Mihalkanin seconded the motion. Mr. Taylor stated he has received several <br />calls and letters regarding this Ordinance. He inquired as to the <br />proposed amendments. Mr. Diaz stated he understood the existing Ordinance <br />to read the total square footage and if an additional side was added, then <br />it would add to the square footage. Jon James, Assistant Planner of the <br />Planning and Development Department, stated the current Ordinance reads <br />only one side countS towards the square footage. He stated at the last <br />CitY Council Meeting he understood the Council's interpretation to be if <br />someone was permitted for a 100 square-foot sign and they wanted to <br />replace it with a two-sided sign, each being 50 square feet, then it would <br />be permitted. He also stated this would be taking down signs where the <br />City does not want signs and allowing them to replace them in other <br />locations. Mr. Mark Taylor stated the proposed Ordinance reads a two- <br />sided sign, each being 100 square feet will count as 200 square feet. The <br />CoUncil then voted unanimously for adoption of the Ordinance on emergency. <br /> <br />Mayor Habingreither introduced for consideration adoption of a Resolution, <br />the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />EXPRESSING THE CITY'S CONTINUED SUPPORT FOR A STATE AIRPORT FOR <br />CENTRAL TEXAS IN SAN MARCOS; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Ms. Narvaiz moved for adoption of the Resolution and Mr. Taylor seconded <br />the motion. Mr. O'Leary stated Representative Patrick Rose contacted him <br />regarding sponsorship of a Bill to designate San Marcos as the State <br />Airport for Central Texas at the Texas Special Legislative Session. He <br />stated Council has previously supported offering our Municipal Airport for <br />this purpose. Mayor Habingreither stated he feels this is something the <br />Council should consider ~eviewing, and he would support this Resolution. <br />Mr. Montoya stated this Resolution is something he has supported since he <br />has been on the Council because of the economic opportunity it has to <br />offer San Marcos. Mr. Taylor inquired whether the Airport Commission <br />supports this Resolution. Mr. O'Leary stated there are a few members who <br />do not support this Resolution, but the majority does. He stated the <br />State would come in and do some repairs and incur other expenses which the <br />City could not afford. The Council then voted unanimously for adoption of <br />the Resolution. <br /> <br />Mayor Habingreither introduced an Executive Session pursuant to the <br />Government Code, Section 551.071, to seek the City Attorney's advice <br /> <br /> <br />
