I I I o,,~ /0 C> l88 ORDINANCE 1978-34 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AMENDING CHAPTER 21 OF THE CODE OF ORDINANCES OF THE CITY OF SAN MARCOS, ENTITLED "PUBLIC SAFETY", SAID ORDINANCE BEING RECORDED IN VOLUME 45, PAGE 172 OF THE MINUTES OF THE CITY COUNCIL; AND ESTABLISHING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, ~~EXAS: Part 1. That Chapter 2l of the Code of Ordinances' be and is hereby amended in the following respects and particulars: (I) Section 21-1 be and is hereby amended to read as follows: Section 2l-l. PUBLIC SAFETY DIVISION CREATED. There is hereby created a division of public safety within the City of San Marcos, the head,:of which shall be the director of public safety. The director shall be appointed by the city manager and confirmed by the city council. The director shall be the chief administrator and supervisor of the police and fire department heads and any other department heads desi9nated by the city manager. The director shall report directly .to the city manager. (2) Section 21-2 be and is hereby amended to read as follows: Section 2l-2. POLICE DEPARTMENT CREATED. There is hereby created within the.public safety division a department of police, the head of which shall be the commander of pOlice. The commander shall be appointed by the city imanager and confirmed by the city council. The commander shall be the administrator and supervisor of all law enforcement officers employed by the city assigned within the police department, and shall report directly to the director of public safety. (3) Section 2l-3.be and is hereby amended to read as follows: Section 21-3. FIRE DEPARTMENT CREATED. There is hereby created within the public safety division a fire department, the head of which shall be the commander of the fire department. The commander shall be appointed by the city manager and confirmed by the city council. The commander shall be the administrator and supervisor of all personnel employed by the city within the fire department, and shall report directly to the director of public safety. (4) Section 21-4 be and is hereby repealed in its entirety a~d its section number reserved for future use. (5) Section 21-5 be and is hereby amended to read as follows: Section 21-5. APPOINTMENT OF MEMBERS.,. (a) All personnel employed within the police.department shall be appointed in the manner as provided in Article 1269m of the Revised Civil Statutes of Texas (1925); provided, however, nothing herein shall be construed so as to include the commander ,tneLpolfi:ce'(depattment 'whoxp'srforms;;a s:1t:helfhe13.cn fo f, Lsuch1 'departmen t within such appointment procedures, other than those provided in section 21-2 of this chapter and Section 15.ofArticle 1269m. (b) There shall be as many members of the police department as the city council shall deem fit and proper, and as enacted pursuant to section 2-3l of this Code dealing with police and fire civil service.
