<br />I <br /> <br />I <br /> <br />I <br /> <br />o,,~ <br />/0 C> l88 <br /> <br />ORDINANCE 1978-34 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS AMENDING CHAPTER <br />21 OF THE CODE OF ORDINANCES OF THE CITY OF <br />SAN MARCOS, ENTITLED "PUBLIC SAFETY", SAID <br />ORDINANCE BEING RECORDED IN VOLUME 45, PAGE <br />172 OF THE MINUTES OF THE CITY COUNCIL; AND <br />ESTABLISHING AN EFFECTIVE DATE. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, ~~EXAS: <br /> <br />Part 1. That Chapter 2l of the Code of Ordinances' be and is hereby <br />amended in the following respects and particulars: <br /> <br />(I) Section 21-1 be and is hereby amended to read as follows: <br /> <br />Section 2l-l. PUBLIC SAFETY DIVISION CREATED. <br /> <br />There is hereby created a division of public safety within <br />the City of San Marcos, the head,:of which shall be the director <br />of public safety. The director shall be appointed by the city <br />manager and confirmed by the city council. The director shall <br />be the chief administrator and supervisor of the police and <br />fire department heads and any other department heads desi9nated <br />by the city manager. The director shall report directly .to <br />the city manager. <br /> <br />(2) Section 21-2 be and is hereby amended to read as follows: <br /> <br />Section 2l-2. POLICE DEPARTMENT CREATED. <br /> <br />There is hereby created within the.public safety division a <br />department of police, the head of which shall be the commander <br />of pOlice. The commander shall be appointed by the city imanager <br />and confirmed by the city council. The commander shall be the <br />administrator and supervisor of all law enforcement officers <br />employed by the city assigned within the police department, and <br />shall report directly to the director of public safety. <br /> <br />(3) <br /> <br />Section 2l-3.be and is hereby amended to read as follows: <br /> <br />Section 21-3. FIRE DEPARTMENT CREATED. <br /> <br />There is hereby created within the public safety division a <br />fire department, the head of which shall be the commander of the <br />fire department. The commander shall be appointed by the city <br />manager and confirmed by the city council. The commander shall <br />be the administrator and supervisor of all personnel employed <br />by the city within the fire department, and shall report directly <br />to the director of public safety. <br /> <br />(4) <br /> <br />Section 21-4 be and is hereby repealed in its entirety a~d its <br />section number reserved for future use. <br /> <br />(5) <br /> <br />Section 21-5 be and is hereby amended to read as follows: <br /> <br />Section 21-5. APPOINTMENT OF MEMBERS.,. <br /> <br />(a) All personnel employed within the police.department <br />shall be appointed in the manner as provided in Article 1269m <br />of the Revised Civil Statutes of Texas (1925); provided, however, <br />nothing herein shall be construed so as to include the commander <br />,tneLpolfi:ce'(depattment 'whoxp'srforms;;a s:1t:helfhe13.cn fo f, Lsuch1 'departmen t <br />within such appointment procedures, other than those provided in <br />section 21-2 of this chapter and Section 15.ofArticle 1269m. <br /> <br />(b) There shall be as many members of the police department <br />as the city council shall deem fit and proper, and as enacted <br />pursuant to section 2-3l of this Code dealing with police and <br />fire civil service. <br />
