<br />l88a <br /> <br />(6) Section 21-6 be and is hereby amended to read as follows: <br /> <br />Section 21-6. POWERS AND DUTIES. <br /> <br />All duly certified and appointed members of the police de- <br />partment under the authority of the city shall have all the <br />powers and duties conferred on local law en150rcement officers <br />by the general laws of the State of Texas, and by the ordinances <br />of the city. <br /> <br />(7) Article III, "Department of Criminal Investigation", comprised <br />of Sections 21-15 through 21-24, be and is hereby repealed and <br />deleted in its entirety to be replaced by a new Article III <br />reading as follows: <br /> <br />I <br /> <br />ARTICLE III. FIRE DEPARTMENT. <br /> <br />Section 21-25. APPOINTMENT OF MEMBERS. <br /> <br />(a) All personnel employed within the fire department of the <br />city shall be appointed in the manner as provided in Article <br />l269m of the Revised Civil Statutes of Texas (1925); provided, <br />however, nothing herein shall be construed so as to include <br />the commander of the fire department who performs as the head <br />of such department within such appointment procedures, other <br />than those provided in section 2l-3 of this chapter and Section <br />15 of Article l269m. <br /> <br />(b) There shall be as many members of the fire department as <br />the city council shall deem fit and proper and as enacted pur- <br />suant to section 2-31 of this Code dealing with police and <br />fire civil service. <br /> <br />S'~ction 21-26. POWERS AND DUTIES. <br /> <br />All duly certified and appointed members of the fire depart- I <br />ment under the authority of the city, shall have all the powers <br />and duties conferred on local fire department personnel by the <br />statutes and cases made and provided by the State of Texas, <br />and by the ordinances of the city. <br /> <br />Sections 21-27----21-34. RESERVED. <br /> <br />(8) Article IV be and is hereby amended to become new Article III <br />as described above. <br /> <br />(9) Article V be and is hereby amended to become new Article IV <br />and to read as follows: <br /> <br />ARTICLE IV. LAW ENFORCEMENT DUTIES. <br /> <br />Section 21-35. ENFORCEMENT OF LAWS. <br /> <br />Members of the police department shall be diligent in enforc- <br />ing within the city the laws of the State of Texas, this Code <br />and any other ordinances of the city, and for such purposes <br />are vested with all the powers and duties conferred on local <br />15W enforcement officers by the general laws of the State of <br />Texas and by ordinances of the ~ity. Members of the police I <br />department are declared to be peace officers within the pur- <br />view of state law. <br /> <br />Section 21-36. ARREST WITHOUT WARRANT. <br /> <br />Members mm the police department shall have the authority to <br />arrest, without warrant, persons found in suspicious places, <br />and under circumstances which reasonably show that such per- <br />sons have been guilty of some felony or breach of the peace, <br />or threaten, or are about to commit some offense against the <br />laws. <br />
