l88a (6) Section 21-6 be and is hereby amended to read as follows: Section 21-6. POWERS AND DUTIES. All duly certified and appointed members of the police de- partment under the authority of the city shall have all the powers and duties conferred on local law en150rcement officers by the general laws of the State of Texas, and by the ordinances of the city. (7) Article III, "Department of Criminal Investigation", comprised of Sections 21-15 through 21-24, be and is hereby repealed and deleted in its entirety to be replaced by a new Article III reading as follows: I ARTICLE III. FIRE DEPARTMENT. Section 21-25. APPOINTMENT OF MEMBERS. (a) All personnel employed within the fire department of the city shall be appointed in the manner as provided in Article l269m of the Revised Civil Statutes of Texas (1925); provided, however, nothing herein shall be construed so as to include the commander of the fire department who performs as the head of such department within such appointment procedures, other than those provided in section 2l-3 of this chapter and Section 15 of Article l269m. (b) There shall be as many members of the fire department as the city council shall deem fit and proper and as enacted pur- suant to section 2-31 of this Code dealing with police and fire civil service. All duly certified and appointed members of the fire depart- I ment under the authority of the city, shall have all the powers and duties conferred on local fire department personnel by the statutes and cases made and provided by the State of Texas, and by the ordinances of the city. Sections 21-27----21-34. RESERVED. (8) Article IV be and is hereby amended to become new Article III as described above. (9) Article V be and is hereby amended to become new Article IV and to read as follows: ARTICLE IV. LAW ENFORCEMENT DUTIES. Section 21-35. ENFORCEMENT OF LAWS. Members of the police department shall be diligent in enforc- ing within the city the laws of the State of Texas, this Code and any other ordinances of the city, and for such purposes are vested with all the powers and duties conferred on local 15W enforcement officers by the general laws of the State of Texas and by ordinances of the ~ity. Members of the police I department are declared to be peace officers within the pur- view of state law. Section 21-36. ARREST WITHOUT WARRANT. Members mm the police department shall have the authority to arrest, without warrant, persons found in suspicious places, and under circumstances which reasonably show that such per- sons have been guilty of some felony or breach of the peace, or threaten, or are about to commit some offense against the laws.
