<br />25. If the Project includes a water supply system and/or water facili- <br />ties, no construction shall be commenced until it has been established <br />to the satisfaction of the Government that the quality and quantity of <br />water available to the Project is sufficient for the purposes of the <br />Project; provided, however, that if the quality and quantity of water <br />available cannot be determined without the construction of part of the <br />Project, the Government may authorize the construction of such part <br />prior to authorizing construction of the remainder of the Project. <br /> <br />26. The Grantee/Borrower hereby covenants that in the event it is <br />authorized by the Government to lease any facilities constructed as <br />part of this Project to concessionaires or operators, it will obtain <br />from such concessionaire(s) or operator(s) and submit to the Government <br />properly executed Forms (e.g., Certificate of Non-Relocation; Assurances I <br />of Compliance with The Department of Commerce Regulations under Title VI <br />of the Civil Rights Act of 1964; and Assurance of Job Opportunities for <br />The Unemployed) prior to completion of the lease agreement(s). <br /> <br />27. The Government may, at its option, require the Grantee/Borrower <br />to include in the request for construction bids a requirement that <br />each responsive bidder will provide bids on two schedules: (1) one <br />based on continuing conatruction throughout the period of adverse <br />weather, and (2) one based on the normal shutdown during the same period. <br />The Grantee/Borrower must reserve the right to award the construction <br />contract on the basis of the low bid on either schedule. <br /> <br />Care must be taken to insure that all work performed during the periods <br />of adverse weather are structurally sound and as durable as work performed <br />under favorable weather conditions. The requirement for work during <br />adverse weather conditions shall be so stated that the contractor shall <br />not be required to continue work during actual conditions covered by the <br />following weather warnings as issued by the U.S. Weather Bureau: (1) snow <br />and/or heavy icing, (2) severe thunderstorms, (3) tornado, or (4) hurricane. <br /> <br />28. Nonexpendable personal property acquired with Government funds will <br />be retained until there is no longer a need to accomplish the purpose of <br />the Project. After that time the Grantee/Borrower shall first use such <br />property in other Government projects or secondly in projects of other <br />Federal governmental agencies; such other projects being those of the <br />Grantee/Borrower herein. When the Grantee/Borrower is unable to use the I <br />property as aforesaid the regulations of the Government shall be applied <br />as published in the Code of Federal Regulations. Property records shall <br />be maintained accurately and provide for: a description of the property; <br />manufacturer's serial number or other identification number, percentage <br />of funds used in the purchase of the property; location, use and condition <br />of the property, and such other data as may be required in the regulations <br />published by the Government in the Code of Federal Regulations. A physical <br />inventory of the property shall be taken, and the results reconciled with <br />the property records, at least once every two years. A control system <br />shall be in effect to insure adequate safeguards to prevent loss, damage or <br />theft, any of which shall be investigated and fully documented. <br /> <br />- 18 - <br />
