If construction work is to be performed in a geographical area covered <br />by bid conditions issued by the Office of Federal Contract Compliance, the <br />Grantee/Borrower shall include such bid conditions as part of its construc- <br />tion contract, or any modification thereof. In such areas, the Grantee/ <br />Borrower shall also include in contracts for construction work, or any <br />modification thereof, provisions requiring the contractor to report its <br />manpower utilization on a monthly basis using the latest Optional Form 66, <br />Monthly Manpower Utilization Report. <br /> <br />I <br /> <br />30. Any program income earned by the Project between the date of approval <br />and the date of completion shall be deducted from the total Project costs <br />for the purpose of determining the net costs on which the Federal share of <br />costs will be based; or added to funds committed to the Project by the <br />Government and the Grantee/Borrower and used to further eligible program <br />objectives. <br /> <br />31. The Grantee/Borrower shall have the sole authority and full responsi- <br />bility, without recourse to the Federal Government or any of its agencies, <br />for the settlement and satisfaction of all contractual and administrative <br />issues arising out of this grant and/or loan. <br /> <br />32. The Grantee/Borrower shall submit quarterly performance reports to <br />assure that time schedules are being met and that projected work units by <br />time periods are being accomplished. Between required performance report- <br />ing dates, Grantee/Borrowers shall inform the Government of all problems, <br />delays or adverse conditions which will materially affect the ability to <br />attain program objectives, prevent the meeting of time schedules and goals, <br />or preclude the attainment of project work units by established time periods. <br />This disclosure shall be accompanied by a statement of the action taken, or <br />contemplated, and any Federal assistance needed to resolve the situation. <br /> <br />I <br /> <br />33. The Grantee/Borrower shall constantly monitor performance under this <br />Project to assure that time schedules are being met, and other program <br />performance goals are being achieved. At least annually, on the anniversary <br />date of final acceptance by the Grantee/Borrower of the Project, and on the <br />same date for five years thereafter, the Grantee/Borrower shall submit to <br />the Government a report which briefly presents a comparison of actual program <br />accomplishments to the goals established for the period, giving reasons for <br />slippage where established goals were not met, and including other pertinent <br />information, when appropriate, such as, but not limited to, analysis and <br />explanation of cost overruns or high unit costs or delays. In addition, <br />should events occur which have a significant impact upon the Project, the <br />Grantee/Borrower agrees to inform the Government as soon as any serious <br />problems or adverse conditions or highly favorable developments or events <br />become known. <br /> <br />34. The Grantee/Borrower shall notify the Government promptly whenever the <br />amount of authorized grant is expected to exceed the needs of the Grantee/ <br />Borrower by more than $5,000 or five per cent of the grant, whichever is <br />greater. <br /> <br />- 19 - <br />
