<br />I <br /> <br />I <br /> <br />I <br /> <br />e <br /> <br />-2- <br /> <br />of San Marcos and Hays County. Scheib shall not use said <br />premises and shall not permit them to be used for any other <br />purpose without first obtaining the written consent of City. <br />III. <br />Scheib agrees to neither remove or destroy any improvements <br />on the demised property nor add to or alter the same without <br />first obtaining the written consent of City. In connection <br />therewith, City may require submission of proposed designs, floor <br />plans, construction plans, specifications, and contract documents <br />therefor and, if then approved, shall incorporate all within <br />this Agreement as attachments thereto. <br />W. <br /> <br />Scheib, at its own expense, shall keep the premises in a <br />safe, sanitary, and sightly condition and in good repair and <br />shall yield the same back to City upon the termination of this <br />Agreement in such condition and repair, ordinary wear and tear <br />excepted. However, City covenants with Scheib that it will at <br />all times during the term of this Agreement, at its own expense, <br />maintain and keep the main walls, roof, and the foundation of <br />any structure or structures built on the leased property in. good <br />and substantial repair, order, and condition; provided, however, <br />that no liability either in contract or tort shall result from <br />failure to repair, except where City has had a reasonable time <br />to repair after notice given by Scheib. Minor building maintenance <br />including such items as interior painting, replacement of floor <br />or ceiling tile, and replacement of window glass, shall be the <br />responsibility of Scheib. The expense of placing and maintaining <br />any permanent improvements other than landscaping upon the <br />grounds of the demised premises shall be the responsibility <br />of Scheib. <br /> <br />v. <br />Scheib shall be responsible for the provision of custodial <br />and housekeeping supplies necessary to keep the MH/MR facility <br />in a safe, sanitary, and sightly condition. <br />
