<br />I <br /> <br />I <br /> <br />I <br /> <br />. <br /> <br />-3- <br /> <br />VI. <br />Scheib shall be responsible for all utilities necessary <br />for the operation of the MH/MR facility. <br />VII. <br />It is expressly agreed and understood that no authorization <br />exists in Scheib to subject the demised premises, or any part <br />thereof, to mechanic's and/or materialman's liens. Neither this <br />Lease, nor any interest therein, nor any estate thereby created, <br />shall pass to any trustee or receiver in bankruptcy or to any <br />other receiver or assignee for the benefit of creditors or <br />otherwise by operation of law. In any of these events, this <br />Lease Agreement may be immediately cancelled at the option of <br />City by giving notice in writing to Scheib of such cancellation. <br />VIII. <br />Scheib covenants and agrees not to discriminate upon the <br />basis of religion, race, sex, or national origin in the operation, <br />use, and occupancy of the property hereby demised to Scheib for <br />use as a mental health and mental retardation treatment and <br />consultation facility. <br /> <br />IX. <br />Scheib covenants and agrees to offer mental health and <br />mental retardation treatment and consultation services to the <br />citizens of the City of San Marcos and Hays County at the demised <br />premises through its cooperative agreement with the Austin State <br />School and the Austin State Hospital. These services are to be <br />made available to the aforementioned areas at costs established <br />by the Texas Department of Mental Health and Mental Retardation. <br />X. <br />Scheib shall not assign or transfer this Lease or any <br />interest therein nor sublet said premises or any part thereof <br />without the written consent of City. <br />XI. <br />Scheib covenants and agrees to indemnify and save City <br />harmless from all damages, claims, and demands of any person(s) <br />by reason of the operation and conduct of the Scheib's MH/MR <br />
