<br />I <br /> <br />?"- <br />m <br />CD <br /><( <br /><( <br /><( <br /> <br />I <br /> <br />I <br /> <br />20 <br /> <br />RESOLUTION 1978-55-R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, SUSPENDING <br />THE OPERATION OF PROPOSED NATURAL GAS <br />UTILITY RATE SCHEDULES FILED BY ENTEX, <br />INC. FOR A PERIOD OF ONE HUNDRED TWENTY <br />(120) DAYS BEYOND AUGUST 18, 1978, THE <br />DATE ON WHICH SAID SCHEDULE WOULD OTHER- <br />WISE GO INTO EFFECT. <br /> <br />WHEREAS, pursuant to the Texas Public Utility Regulatory <br />Act, exclusive original jurisdiction for the regulation of <br />rates and services provided by gas utilities within the City <br />of San Marcos lies with governing body, to-wit: the San <br />Marcos City Council; and, <br /> <br />WHEREAS, Entex, Inc. did, on July 14, 1978, file with <br />the City Council new schedules of rates for natural gas <br />utility service to become effective within the City of San <br />Marcos on August 18, 1978; and, <br /> <br />WHEREAS, the City Council desires additional time to <br />ensure proper study, investigation, presentation of evidence, <br />and adequate public hearing of such rate change application. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF SAN MARCOS, TEXAS, THAT: <br /> <br />Part 1. <br /> <br />Pursuant to Section 43(d) of the Public Utility <br />Regulatory Act, the operation of the Entex, Inc. <br />proposed new rate schedules filed with the City of <br />San Marcos on July 14, 1978, be and is hereby <br />suspended for a period of one hundred twenty (120) <br />days from and beyond August 18, 1978, for further <br />study, investigation, presentation of evidence, <br />and public hearing. <br /> <br />That this Resolution shall become effective <br />immediately from and after its passage. <br /> <br />Part 2. <br /> <br />APPROVED AND ADOPTED this the 24th day of July <br />1978. <br /> <br />rk?~~ <br /> <br />Mayor <br /> <br />;}~~ <br /> <br />Doriss Hambrick <br />City Secretary <br /> <br />;;;u g~ <br /> <br />Charles E.
