I ?"- m CD <( <( <( I I 20 RESOLUTION 1978-55-R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, SUSPENDING THE OPERATION OF PROPOSED NATURAL GAS UTILITY RATE SCHEDULES FILED BY ENTEX, INC. FOR A PERIOD OF ONE HUNDRED TWENTY (120) DAYS BEYOND AUGUST 18, 1978, THE DATE ON WHICH SAID SCHEDULE WOULD OTHER- WISE GO INTO EFFECT. WHEREAS, pursuant to the Texas Public Utility Regulatory Act, exclusive original jurisdiction for the regulation of rates and services provided by gas utilities within the City of San Marcos lies with governing body, to-wit: the San Marcos City Council; and, WHEREAS, Entex, Inc. did, on July 14, 1978, file with the City Council new schedules of rates for natural gas utility service to become effective within the City of San Marcos on August 18, 1978; and, WHEREAS, the City Council desires additional time to ensure proper study, investigation, presentation of evidence, and adequate public hearing of such rate change application. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, THAT: Part 1. Pursuant to Section 43(d) of the Public Utility Regulatory Act, the operation of the Entex, Inc. proposed new rate schedules filed with the City of San Marcos on July 14, 1978, be and is hereby suspended for a period of one hundred twenty (120) days from and beyond August 18, 1978, for further study, investigation, presentation of evidence, and public hearing. That this Resolution shall become effective immediately from and after its passage. Part 2.
