• AGREEMENT FOR ELECTION SERVICES <br />The City of San Marcos (the "City") and the Hays County Election Administrator, Joyce <br />Cowan (the "Officer") hereinafter collectively referred to as the "Parties," enter into this <br />Election Services Agreement (the "Agreement"). <br />WITNESSETH <br />WHEREAS, the Officer and the City, are authorized to execute this Agreement <br />pursuant to the provisions of the Texas Election Code, Chapter 31, Subchapter D, for the <br />conduct and supervision of the City's General and Special Election to be held on <br />November 4, 2008 and, if necessary, a runoff election will be held no earlier than the <br />20th day or later than the 45th day after the date of the City's final canvass (the <br />"Election(s)"). <br />WHEREAS, the Hays County Election Administrator of Hays County, Texas <br />(the "County"), is the County Officer in charge of election duties; and <br />WHEREAS, the City is a political subdivision situated within the County; and <br />WHEREAS, the City and the Officer have determined that it is in the public <br />interest of the City that the Parties enter into this Agreement for the Officer's provision <br />of certain election services, equipment and supervision needed to conduct the Election(s); <br />• and <br />NOW, THEREFORE, in consideration of the mutual covenants and agreements <br />hereinafter set forth, the Parties hereby contract, covenant and agree as follows: <br />Article 1. Officer's Duties and Services. <br />For each election the Officer will: <br />a) Recruit and appoint qualified persons to serve as presiding election judges and <br />alternate judges. <br />b) Train judges and clerks. <br />c) Arrange for the use of polling places. <br />d) Procure and distribute election supplies, including preparation, printing and <br />distribution of ballots. <br />e) Assemble and edit lists of registered voters for use in conducting each <br />election, in conformity with the boundaries of the election precincts <br />established for the Election(s). <br />f) Procure, prepare, and distribute election equipment. <br />g) Transport equipment to and from the polling places and issue election supplies <br />to the precinct judges. <br />h) Supervise the conduct of early voting and supply adequate personnel to serve <br />• as deputy early voting clerks.
