<br />- 2- <br /> <br />said property granted herein will terminate. The use' of <br /> <br />firearms, explosives, tear gas, or obstacles in or near the <br /> <br />I <br /> <br />leased area or at the San Marcos Municipal Airport is specifically <br />prohibited. <br />It is understood that the property shall not be available <br />to the general public while property is in use by Lessee. <br />Lessee shall have the exclusive right to schedule its activities <br /> <br />and use of the property subject to the exclusive right of <br /> <br />the City of San Marcos to demand that Lessee cease its operations <br />temporarily during those periods of time when special events <br />which are sanctioned by the City of San Marcos are scheduled <br />on the leased property. This exclusive right of the City of <br />San Marcos is conditioned.on their giving Lessee thirty (30) <br />days written notice of the scheduled events or lesser notice <br />upon mutual agreement of both parties. <br />3. During the time of war or national emergency, Lessor <br />II shall have the right to lease the landing area, airport, or any <br />part thereof to the United States Government for military or <br /> <br />naval use, and, if such lease is executed, the provision of this <br /> <br /> <br />instrument insofar as they are inconsistent with the provisions <br /> <br />of the lease to the Government, shall be suspended. This lease <br />shall be subordinate to the provisions of any existing or future <br /> <br />agreement between Lessor and the United States, relative to the <br />operation or maintenance of the airport, the execution of which <br />has been or may be required as a condition precedent to the <br /> <br />expenditure of Federal funds for the development of the airport. <br /> <br />4. TERM OF THIS LEASE AGREEMENT: Permission to use the <br /> <br />I <br /> <br />property granted herein shall be for a six (6) month period <br />beginning September 15, 1978 and ending March 15, 1979; thereafter, <br />permission to use the property granted herein shall be on a month- <br />to-month basis, providing that the City may at any time after the <br /> <br />first six (6) months of this ~ease, with or without cause, <br />terminate and revoke this agreement and permission to use the <br />property herein granted and may take possession of the property <br /> <br />without being guilty in any manner of trespas,s upon giving sixty <br />(60) days written notice to the Lessee. <br />
