117 <br />ORDINANCE NO. 1978-50 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, APPROVING THE <br />PRICE AND CONDITIONS OF THE SALE BY THE <br />CITY OF SAN MARCOS, TEXAS, OF PART OF <br />LOT 1, BLOCK 8,OF THE D. S. COMBS <br />ADDITION FURTHER DESCRIBED BY METES AND <br />BOUNDS IN THE ATTACHED EXHIBIT A AND <br />ALSO KNOWN AS URBAN RENEWAL PARCEL NUMBER <br />DS-8-1, LOCATED WITHIN THE TEX. A-6 <br />NEIGHBORHOOD DEVELOPMENT PROGRAM AREA TO <br />MANUELA D. AMPARAN; AUTHORIZING THE MAYOR <br />TO EXECUTE A WARRANTY DEED TO MANUELA D. <br />AMPARAN; AND DECLARING AN EMERGENCY. <br />WHEREAS, the City of San Marcos, Texas, advertised for bids <br />for the sale of that certain real property known as part of <br />Lot 1, Block 8, D. S. Combs Addition further described by <br />metes and bounds in the attached Exhibit A and also known as <br />Urban Renewal Parcel Number DS-8-1 located within the Tex. A-6 <br />Neighborhood Development Area in the San Marcos Record, a <br />local newspaper with a general circulation in the County of <br />Hays, State of Texas; and, <br />WHEREAS, pursuant to said advertisement a bid was submitted <br />by Manuela D. Amparan for said part of Lot 1, Block 8 of the <br />D. S. Combs Addition; and, <br />WHEREAS, the said bid met the minimum disposition price set <br />upon said property by the Board of Commissioners of the Urban <br />Renewal Agency of the City of San Marcos, Texas; and, <br />WHEREAS, the said Board accepted the bid as the highest and <br />best responsible bid for said property by a motion duly passed <br />on November 14, 1978 after the bid opening of November 14, 1978, <br />and, <br />WHEREAS, said motion also approved the terms and conditions for <br />the sale of the said property and recommended the approval of <br />said purchase price and the approval of the terms and conditions <br />for the sale is contained in the bid documents by the City Council <br />of the City of San Marcos, Texas; and, <br />WHEREAS, the aforementioned bid and proposed use set forth in <br />said bid and the sales terms and conditions pertinent thereto <br />conformed to the redevelopment plan for the development of the <br />City as a whole; now, therefore, <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. That the terms and conditions of the sale by the <br />City of San Marcos, Texas, of part of Lot 1, Block 8 of the <br />D. S. Combs Addition further described by metes and bounds in <br />the attached Exhibit A and also known as Urban Renewal Parcel <br />Number DS-8-1 to Manuela D. Amparan are hereby approved. <br />SECTION 2. That the consideration for the sale for said <br />property being $3,500 for 8,749.5 square feet is hereby <br />approved. <br />SECTION 3. That the sale by the City of San Marcos is made <br />subject to restrictions of the Redevelopment Plan for the <br />Tex. A-6 Neighborhood Development Program as approved and <br />amended, said plan is on file and is available for inspection <br />in the office of the Director of Community Development of the <br />City of San Marcos.
