<br />I <br /> <br />I <br /> <br />I <br /> <br />-Z- <br /> <br />WHEREAS, the State has, through authority granted in <br />the Alcoholic Beverage Code, Zoning Statutes, and other <br />legislative enactments recognized the direct and continuing <br />interest of cities in the matter of municipal preventive <br />planning and control of the abuses of public consumption of <br />alcoholic beverages which may potentially interfere with the <br />public health, safety, and morals, and with the property and <br />privacy rights of all individual citizens; and, <br />WHEREAS, the City of San Marcos, a Home Rule City, <br />finds it necessary to participate more closely with the <br />State in the joint regulation and control of the local sales <br />and consumption of alcoholic beverages and the use of property <br />associated therewith, in order to more adequately protect <br />the public health, safety, and welfare, as well as the <br />property and privacy rights of all citizens of the City, and <br />in order to provide for the orderly and prosperous growth <br />and development of the City of San Marcos; and, <br />WHEREAS, the City of San Marcos has a particular and <br />special local interest and responsibility in addition to <br />that of the State in the matter of ensuring that property <br />utilized for the purpose of sale and public consumption of <br />alcoholic beverages on the premises does not become abused <br />to the extent that there is an impairment or interference <br />with the rights and safety of the patrons of such property, <br />or of those of neighbors to such property, or of those of <br />public passers-by to such property, or of the orderly functioning <br />of the administration of the City of San Marcos; and, <br />WHEREAS, the City Council recognizes the need to establish <br />a reasonable and comprehensive local policy to complement <br />and assist that policy of the State in the equitable and <br />effective regulation of the possession, sale, and public <br />consumption of alcoholic beverages and the use of property <br />associated therewith within the City of San Marcos; now, therefore <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS:. <br />
