I I I -Z- WHEREAS, the State has, through authority granted in the Alcoholic Beverage Code, Zoning Statutes, and other legislative enactments recognized the direct and continuing interest of cities in the matter of municipal preventive planning and control of the abuses of public consumption of alcoholic beverages which may potentially interfere with the public health, safety, and morals, and with the property and privacy rights of all individual citizens; and, WHEREAS, the City of San Marcos, a Home Rule City, finds it necessary to participate more closely with the State in the joint regulation and control of the local sales and consumption of alcoholic beverages and the use of property associated therewith, in order to more adequately protect the public health, safety, and welfare, as well as the property and privacy rights of all citizens of the City, and in order to provide for the orderly and prosperous growth and development of the City of San Marcos; and, WHEREAS, the City of San Marcos has a particular and special local interest and responsibility in addition to that of the State in the matter of ensuring that property utilized for the purpose of sale and public consumption of alcoholic beverages on the premises does not become abused to the extent that there is an impairment or interference with the rights and safety of the patrons of such property, or of those of neighbors to such property, or of those of public passers-by to such property, or of the orderly functioning of the administration of the City of San Marcos; and, WHEREAS, the City Council recognizes the need to establish a reasonable and comprehensive local policy to complement and assist that policy of the State in the equitable and effective regulation of the possession, sale, and public consumption of alcoholic beverages and the use of property associated therewith within the City of San Marcos; now, therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:.
