<br />I <br /> <br />I <br /> <br />I <br /> <br />-3- <br /> <br />Part 1. That the ordinance of June 9, 1970, entitled <br />"Alcoholic Beverages", codified as Section 2\-1 of Chapter <br />2\ of the Code of Ordinances of the City of San Marcos be <br />and is hereby amended to read as follows: <br />"Sec tion 2\-1. In accordance wi th the Texas <br />Alcoholic Beverage Code, when any person applies <br />for an alcoholic beverage permit to be issued by <br />the State of Texas and to be utilized within the <br />City of San Marcos, the Mayor, Director of Public <br />Safety or Chief of Police, or City Attorney are <br />authorized to make recommendations regarding said <br />permit applications and to have said recommendations <br />considered by the Alcoholic Beverage Commission or <br />Administrator prior to permit issuance." <br />"Section 2\-2. In accordance with the Texas Alcoholic <br />Beverage Code, the City of San Marcos shall collect <br />a fee in the amount of one-half of the State fee <br />charged for each Alcoholic Beverage Permit issued by <br />the State for premises located within the City of <br />San Marcos. The City Secretary shall duly maintain <br />a record of all such fee payments to the City." <br />"Section 2\-3. No person shall sell, or engage in <br />the business of selling, any alcoholic beverages where <br />the place of business is located within three hundred <br />(300 ) feet of any church, public school, or public <br />hospital, the measurements to be along the property <br />lines of street fronts and from front door to front <br />door and in a direct line across the street intersections <br />where they occur." <br />"Section 2\-4. Immediately upon passage of this <br />ordinance, the following policy shall be in full <br />force and effect regarding the use of property in the <br />City of San Marcos for establishments which dispense <br />
